property here in our community. This viewpoint of our Board explains why they set up the poll
regarding chickens to count ballots NOT returned in the Board's Favor of NOT allowing
chickens. It also explains why the Board disallowed votes from the 35 homeowners who
discarded their ballots not realizing their vote would still be counted as a NO VOTE for
chickens. These 35 homeowners signed a copy of a ballot with their name, address and
signature—and the Board chose to NOT allow their vote because it was not on"their" official
ballot postcard. This was a ballot sent out to get the opinion of the homeowners in our
community. In addition, the Board disallowed votes from 10 homeowners who after receiving
additional information chose to change their ballot to a YES Vote. These 10 Members originally
sent in a NO VOTE, but after understanding that the City of Ramsey's Ordinances do not allow
Roosters and that Chickens must be kept in a fenced in area, these 10 Members signed a copy of
a ballot stating after receiving additional information, they were a YES VOTE! Had the Board
explained this in the letter accompanying the ballot, these 10 Members would have originally
mailed a YES VOTE! The Board conveniently left out this important information: No Roosters
and Chickens must be in a fenced in area. In conclusion, the Board disallowed 45 Members YES
VOTES and counted them as NO VOTES to manipulate their count, forcing their opinion, and
disregarding the voice of the community (270 homeowners). Below recaps the Board's
manipulation of the count:
YES VOTES NO VOTES
156 Confirmed YES Vote Ballots Received & Documented
114 No Votes (includes Non-Returned Ballots) 156 (58%) 114 (42%)
Board Disallowed 45 Members' Yes Votes
And Counted Them as No Votes -45 +45
Board's Adjusted Count after disallowing
45 Members YES Votes And Counted
Them as NO Votes 111 (41%) 159 (59%)
In summary, letters, emails, website banners and documents written by the Board of Directors
have misled the homeowners of Northfork. First, the Board stated they unanimously amended
our covenants, then changed their wording to say they amended our "Association Rules and
Regulations", which this document never existed until November 8, 2016. And, more
importantly, the Board has no Board Minutes for this meeting they say they had on June 12,
2012 when they promulgated "their" rule for No Chickens in Northfork without seeking the
opinions of the 270 homeowners they are to serve.
Lastly, the Board's claim that they received numerous calls from concerned Members about us
canvassing the neighborhood is very surprising. We were very cordial to all homeowners and
many homeowners invited us into their homes to talk to them. The homeowners were
appreciative of our efforts to canvass the neighborhood. Whether the homeowner was a YES
VOTE or a NO VOTE, we never had any negative encounters with any homeowners. The
Board's claim that us canvassing the neighborhood and talking to homeowners has rendered the
voting process unreliable is simply illogical. From the HOA's attorney's letter, it sounds like the
4I Page
