(Dl-a) <br /> <br />County Engineer's letter dated November 16, 1978 (Dl-b) <br />Building Official's memo (D-I-c) <br /> <br />CASE 1: <br /> <br />SUBDIVISION BY METES AND BOUNDS REQUEST FOR; CASE OF TOM <br />HOLKER (Location - Northwest quadrant of the intersection <br />of C.S.A.H. ~5 and County Road #57) <br /> <br />Background: This covers the following: <br /> <br />1) Request for Council approval of the above subdivision of <br />land bymetes and bounds. Council at your meeting of <br />November 13, 1978 deferred action until you had a report from <br />the City Engineer. <br /> <br />2) Issuance of building permits on .the above parcel of land <br />for moved in shell houses, request for. <br /> <br />The following additional information is furnished: <br /> <br />a. Enclosure (1) City Engineer's letter dated November 22, 1978 <br />as requested by Council. (Dl-a) <br />b) Enclosure (2) County Engineer's letter dated November 16, 1978 <br />(Dl-b) <br />Comments/Recommendation on the-above requests: My comments <br />are as follows on the two above requests: <br /> <br />1) Subdivision by metes and bounds of the above property. <br />This is not in the realm of good planning, but I'm of the <br />opinion now that the State law that covers subdivision/platting <br />of 5 acres or more supercedes the City's subdivision code in <br />this situation which does allow for subdivision by metes and <br />bounds. Now, unless the City Attorney can provide you with <br />grounds to deny Mr. Holker's request, I think we have to approve <br />it. It is further recommended that recommendation contained <br />in enclosure (1) be contained in any Council motion approving <br />of this proposed metes and bounds plat. <br /> <br /> <br />
