NOW, THEREFORE, IT IS HEREBY CONVENANTED AND AGREED, that the City Council <br /> <br />has granted its approval to Gateway North Industrial Park plat conditioned .upon <br /> <br />and contingent upon the timely performance by the Developers of the following: <br /> 1. That 143rd Ave. N.W. and Jaspar St. N.W. to its intersection with <br /> <br /> 142nd Ave. N.W. including a temporary cul-de-sac at that i~tersection <br /> be completed in accord with City requirements, with the exception of <br /> asphalt paving, on or before-October 1,-1977. <br /> <br />2.. That.the remaining streets in·theplat-.Witl~be~completed~in~aCcord-~ <br /> with City requirements .before building permits are issued to owners <br /> <br />of property abutting those Streets. <br /> <br />That asphalt paving will be required on all streets within the plat' <br />within 90 days of the date that building permits have been issued on <br />lots comprising 50 percent of that area 'of the pl~texclusive of <br /> <br />easements and public rights of way. <br /> <br />That the developer agrees to notify thepurchas~rs of any of the lots <br />within the plat that asphalt paving has not been made a requirement <br />of the plat approval and that failure of the developer to provide <br />asphalt paving as prescribed in 3. above will result in the provision <br /> <br />of said p~ving as a public improvement with the cost.assessed against <br />the benefitted property.
