' <br /> <br />At the time this plat was approved, the city ordinance required that the developer <br />post a maintenance bond to insure that the roads met city standahds for one year <br />following the issuance of the first building permit in the development. Since the <br />first building permit was issued over one year ago and the streets were not paved, <br />we do not see a need for a maintenance bond. Therefore, you may release the letter <br />of credit for $27,750, which covened the-grading, class five gravel and drainage <br />facilities for 143rd Avenue N.W. and Jasper Street'N.W. <br /> <br />Based on the performance contract, it is our understanding that at the time building <br />permits have been issued to 50 percent of the lot area.the developer will pave the <br />streets within 90 days. Failure by the developer to complete the paving would require <br />that the paving be completed as a public improvement project with the cost assessed <br />against the benefitted property. In addition to the paving of 143rd Avenue N.W. and <br />Jasper Street N.W., the performance contract states that building permits for the <br />property abutting 142nd Avenue N.W. and Limonite Street N.W. would not be issued until <br />those streets are constructed to city standards. <br /> <br />If you have any questions in regard to this development, please let us know. <br /> <br />Very truly yours, <br /> <br />CONSULTING ENGINEERS DIVERSIFIED, INC.' <br /> <br />Peter R.
