ERS AND SALE OPERATION' (sell trailers, farm equipment_,
used cars and Lrucks); CASE OF PHILLIP KERSSEN'

Background: The following is submitted for Your review of the
a~V-4 case:

a) Enclosure (D2-a) Council minutes dated August 28, 1978,
Council authority lgranting a temporary conditional use per-
mit to manufacture trailers and sales operation. Further
directing him to pursue rezoning to UMB.
b) Enclosure (D2-b) Council minutes dated September 25,
]_978, approving the rezoning from UR-1 to UMB.
c) Enclosure (D2-c) Mr. Kerssen's application for special
use permit.
d) Enclosure (B-i) Planning Commission minutes dated
December 11, 1978, which contains their recommendation.
e) Enclosure (D2-d) contain excerpt from Zoning Ordinance
which spells out the permitted uses in this zoning district.

Comments: If you grant this conditional use permit, how are you
~oing to control this operation? It would appear to me that
this operation should be in the appropriate zoning district.
If we do grant this we had better have an air tight conditional
use permit drafted up so we don't end up with a zoning problem.

Council Action: Council in taking their action will be guided
in h. ccordance with paragraphs 170.016D and 170.016E.

AN)PTION OF RESOLUTION REVISING M*S.A.
