Holker <br /> <br />Dear Mr. Goodrich: <br /> <br /> On May 1, 1978, Thomas O. Holker appeared before the Planning and <br />Zoning Commissioner for the City of Ramsey with a proposal for 20 <br />acres of land located on Green Valley Road in the City of Ramsey. <br /> <br /> Basically his proposal was to sell the existing home with <br />7½ acres of land, and to build a private road to the remaining 12½ <br />acres of land along the eastern boundary of the 7½ acres. This <br />required 2 variances. First to allow the 7½ acres to be an acceptable, <br />recordable building site. Second, a variance to allow a private road <br />over 600 feet in length within the City of Ramsey. <br /> <br /> The proper heaking on these requests were held and no <br />objections were made by adjoining landoWners. The Planning and <br />Zoning Commissioner approved the requests as reasonable'and acceptable; <br /> <br /> On May 8, 1978, Mr. Holker appeared before the City Council <br />'for approval of the Planning and Zoning recommendation. His requests <br />were denied without really much discussion as to their respective merits. <br /> <br /> At the council meeting on September 25, 1978, we would like <br />the Council to reconsider and reevaluate their position on Mr. Holker's <br />requests <br /> <br /> Some concern was voiced about the City's responsibilities for <br />the private road. Mr. Holker is prepared to include restrictive cove- <br />nants which run with the land and are binding upon successors in interest <br />that relieve the City of Ramsey of any obligation for upkeep and all types <br />of responsibility. I would be glad to work with you as City Attorney in <br />arriving at language acceptable to you and the Council with respect to <br />these covenants. <br /> <br /> <br />
