CASE 6: CASE 7: CASE 8: CASE 9: -2- Council will be guided by the contents of paragraphs 170.016A through 170.016F of the City Code in their findings. CARSON HOMES, INC. REQUESTING DELAY ON PLANTING OF TREES ON EAST SIDE BORDER OF FLINTWOOD HILLS SUBDIVISION: Reason they're requesting the subject delay is because they are con- templating the development of the balance of the Property which they own to the east of Flintwood Hills. Consequently, they would like to defer the tree planting until a decision can be made on the platting of that property. Comments: If Council does grant the above request they should establish a time limit. ANOKA VOLUNTEER FIRE DEPARTMENT REQUEST FOR 3.2 BEER LICENSE AND BINGO PERMIT: The request for the above license and permit is in conjunction with their 31st annual trap shoot at the St. Anthony Gun Club which on September 10, 1978 they want the above license and permit for-the following times and date at the gun club: 3.2 beer license 12:00 P.M. to 8:00 P.M. 9-10-78 bingo permit 10:00 A.M. to 8:00 P.M. 9-10-78 VARIANCE FROM SUBDIVISION ORDINANCE; CASE OF ALEX WERZ: Background: Mr. Werz purchased a one (1) acre lot (located at 16960 Bison Street N.W.) in August, 1972, with the understand- ing that it was a buildable lot in accordance with the City Code at the time of purchase. Consequently, he needs a variance from paragraph 170.0312A of the City Subdivision Ordinance. Planning and Zoning Commission has reviewed the above in accordance with paragraph 170.0312A of the City's Subdivision Ordinance and recommend that the City Council waive the pro- vision contained in the subdivision code. Please refer to enclosure (B-2) this agenda for Planning and Zoning minutes dated August 21, 1978. ACCEPTANCE OF STREET; CASE OF MAGNESIUM STREET (Located south of Industrial Blvd. and west of Ramsey Terrace Plat: The property owners on this street are prepared to dedicate all the necessary road right aways. It should be noted that the bituminuous pavement is 24 feet wide. (Please refer to the Engineers re- port dated August 17, 1978 which is shown as exhibit #1 on left hand side of Council agenda.) The Planning and Zoning Commission has recommended Council accept the above engineer's report with exception of item 94 in his report. Please refer to enclosure (B-2) this agenda for Planning and Zoning minutes dated August 21, 1978. Council should set escrow amount to be charged to defray engineer- ing and legal costs if they proceed.
