FROM: City Administrator <br /> <br />TO: Mayor and City Council <br /> <br />SUBJ: Council Old Business Critique <br /> <br />CASE 1: ~ENDMENT TO ZONING ORDINANCE REGARDING ACCESSORY BUILDING <br /> <br />CASE 2: <br /> <br />AND ACCESSORY USE (PAR 170.014B City Code): Background - <br /> <br />The City Staff was directed to review and make recommendation <br />to the City Council on Home Occupation and Assessory Use as <br />the enforcement of it as contained in the present City <br />Ordinance: <br /> <br />Findings: The enforcement/control of home occupations is <br />satisfactorily covered by the present City Code (.Par. 170.014E <br />City Zoning Ordinance). However, we do recommend an amend- <br />mend to the present City Code in regards to paragraph 170.014B <br />Assessory Uses of the Zoning Ordinance. We recommend the <br />following amendment to Zoning Ordinance, "Attached garage <br />not be considered an assessory building. Assessory building <br />not to exceed 120 square feet all zoning areas and be a stan- <br />dard wood frame building or steel building on a concrete <br />foundation." <br /> <br />"Assessory'Use shall not include the on site storage or parking <br />of trucks over one(l) tone or unlicensed equipment, loaders, <br />cement mixers, backhoes and similar types of construction <br />and excavation equipment, also including storage of inventory <br />and raw building material (six.month~grandfather of present <br />operators)." <br /> <br />Council action if they desire to amend the zoning ordinance <br />would be to call for public hearing in accordance with para- <br />graph 170.019B. <br /> <br />.New..Sub~ec~t_: The staff further recognizes the need for a <br />Nuisance and Plight Ordinance and that subdivision code should <br />require that all new subdivisions contain covenance that would' <br />cover home occupations, assessory use and assessory building. <br /> <br />AUTHORIZATION FOR MAYOR AND CLERK ADMINISTRATOR TO SIGN'GRANT <br /> <br />AGREEMENT WITH METRO COUNCIL: Your grant agreement with Metro <br />Council for the Critical Rivers Study was received on March 7, <br />1978. However, due to oversight it was not signed and returned <br />to the Metro Council Validation. Consequently we need Council <br />authorization to sign said document so that th~ above may be <br />accomplished so we can get our grant money. <br /> <br /> <br />
