nforming Uses. <br /> <br /> :y Non-Conforming Use is destroyed ~y floods, <br />to the extent of 50 percent or more of its assessed <br />value, it shall not be reconstructed except in <br />conformity w~th the provisions 6f this Ordinance. <br />However, the Board .of Adjustment may. permii~ recon- <br />struction if the use is 16cared outS'~de ~he flood- , <br />way and, upon reconstruction, is adaq~tely <br />floodproofed, elevated, or oth6m~se p~otected <br />in conformity with Section 114.7, B. <br /> <br />Alterations or additions to an~'~on-Con'~orming Use <br />which ~vould result in a substantial increase .' <br />in its flood damage pbtential shall be protected by <br />measures pursuant to Sectio)~ 114,7, B. <br /> <br />The Zoning Administrator shall prepare a list of those <br />non-conforming uses ~hich have been floodproofed <br />or otherwise adequately protected in conformit.y <br />with Section 11~.7, B. <br /> <br />Amendmests. The flood plain designation on zoning, maps <br />shall not be removed from flood plain areas unless it <br />can be shown that the designation is in error. <br />Special exceptions to this rule may be permitted by the <br />Commissioner of Natural Resources if he determines <br />that, throught other measures, lands are protected <br />adequately for the intended uses. . <br /> <br />All amendments to this Ordinance including amendments <br />to the Official Zoning Map must be submitted to and approved <br />by the Commissioner of Natural Resources prior <br />to adoption.
