CASE #: ~5 <br />AUTHORIZING ACQUISITION OF PERMANENT STREET AND UTILITY EASEMENTS <br /> NECESSARY FOR THE EXTENSION OF 160TM LANE NW <br /> By: Patrick Trudgeon, AICP~ Assistant Community Development Director <br /> William Goodrich, City Attorney " <br /> <br />Background: <br /> <br />On July 27, 2004, the City Council reviewed the appraisals regarding tree damage and the possible purchase <br />of a 66-foot wide road easement through the Steve and Christy Dusbabek and Francis and Lorri Kaas <br />properties. The City Council voted to acquire the property through negotioans or eminent domain if <br />necessary. Staff is bringing forward a resolution that would authorize the use of eminent domain to <br />purchase the property in order to keep to the designated timeline of all parties. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br /> <br />Site locatiol~ Map <br />Draft City Council Minutes dated July 27, 2004 <br />Proposed Resolution <br /> <br />Notification: <br /> <br />This case is not a public hearing. Staff did, however, send indivdual notice to the adjacent property owners, <br />the Dusbabek and Kaas families. <br /> <br />Observations: · <br /> <br />Staff is bringing the resolution forward in order to begin the process of acquiring the road easement in case <br />the City and property owners are unable to reach a negotiated settlement. It should be noted that Staff <br />strongly desires to reach a mutally satisfactory agreement regarding the purchase of the road easement. <br />However, in the event that eminent domain will need to be utilized, adoption o£the attached resolution will <br />keep the City on track to be able to acquire the property in a timely manner. <br /> <br />Recommendation: <br /> <br />Staff recomends approval of the attached resolution. <br /> <br />City Council Aciton: <br /> <br />Motion to adopt Resolution #04-08- authorizing the acquistion of permanent street and utility <br />easements necessary for the extension of 160th Lane NW. <br /> <br />-or- <br />Motion to deny resolution. <br /> <br />Review Checldist: <br />City Adlninistrator <br />Community Development Director <br />City Attorney <br /> <br />CC: 08/10/04 <br /> <br />-285- <br /> <br /> <br />
