Staff allowed <br />Mr. Bauer to remove trees for the driveway in J;anuary in preparation for construction of a house <br />on the new lot. After the removal of trees, it was determined that when the land to the east of the <br />Bauer property was subdivided in. 1964,. 160"' Lane was not dedicated as a public.road.. It was <br />found that although an easement for road purpose was created there was no indication that the <br />easement was dedicated to the City. Staff has received both'appraisals of the Dusbabek and Kaas <br />properties as directed by the Council. At this point a decision needs to be made On howto settle <br />this matter. Mr. Bauer and the Dusbabeks have requested a quick resolution. Mr. Bauer needs a <br />decision by August 1st. He noted staff has broached the subject with Mr, Bauer about the <br />possible purchase of the road easelnent. The Council needs to discuss the rnarter of whether the <br />City would' purchase the easement, in which case the motion would be to begin negotiations to <br />purchase the easement. Condemnation authorization would also be needed for the case that it is <br />needed. <br /> <br />Lori Kaas? 7155 - 160"' Lane NW, stated she is representing herself and her husband. She <br />questioned if they are not actually discussing numbers tonight. She stated they thought the figure <br />of $1,700 was an insult, as wooded acreage hardly exists.
