Councihnember Elvig indicated he abstained from this previously because Gre:g Bauer is his
brother-in-law. He noted when they plotted Mr. Bauer's property, a stipulation was placed on
ooin(, east/west across this properw.. This Council
Mr. Bauer that he
decided that was a good idea. and they are now saying they would neverdo that and why would
they consider going east/west. That was a stipulation for Mr. Bauer to have his house:plotted on

Councilmember Kurak inquired if there is a possibility of the road going across east/west on eh.e ."

Assistant Public Works Director replied it would cro~'~ wetlands. There would be impact.-t~
wetlands if the road is built at either 1612. or t60"~ :'- '

Councihnember Kurak stated that is private propert~'"'0~ned by these individuals. The City
caused this damage, but it does not g~ve them the right to go back and say they are going to take
the property now. That goes against every ~am she stands for. The Council is being asked to
buy an easement for one house, but there is available access to th'i's.parcet from':.:the north; it is not
landlocked. -- '-'

Mayor Gamec commented if the driveway ~oes in from the north Mr. Dusbabek will lose a lot of
property.

Councilmember Kurak stated Mr. Bauer could purchase a dr/~eway parcel. It is inappropriate to
purchase the easement. There is not an easement there now, and to assume now there will be
because the City caused damage is wrong.'.

Councihnember Strommen inquired of Mrs. Kaas' reaction to the idea of an easement with some
restrictions on it.

Mrs. Kaas replied she is reluctant to offer her reaction without her husband being here. She
would need to discuss it with him.

Councilmember Elvig asked Councilmember Kurak if language being included with restrictions
that there not be any development until all three parties want to develop would satis~ her
concerns.

Councilmember Kurak replied the restrictions do not affect her; they affect the people that live
there. ~q~ether there was to be an a~eement on one year or 20 years, there could be a boom and
there would be a road going tkrough there. She is objecting to paying for an access to someone's
home and setting a precedent.

.Councilmember Elvig stated this Council required an easement from Mr. Bauer on the ghost plot
of his property. It is a contradiction to say they will never do an easement here when this
Council already decided there will be one.

CiU, Council/July 27, 2004
Page 15 of' 34

-291-
