Mi'. Bauer repiJed the entire subdivision is just over 13 acres, There is wetiand on the prope~y <br />and there was delineation done. Tlaere wouid be about seven buiidable acres at the most. The <br />-ghost plot is accurate as to what tots there could be. but it is not accurate as to what is the <br /> buiidable property'. He noted to cievelop the property: City sewer and water would be needed. <br /> <br />Ms. K. aas questioned when Mr. Bauer miaht develop the prope~y, <br /> <br />Mr. Bauer replied at this time. as far as he knows there is no expectation for City sewer.and <br />water. At this time he does not plan on developing it at all. :,' · <br /> <br />Mr. Dusbabek stated his aositioz would be if the City looks at purchasing the easement it sounds": <br />tike they can put conditions in there about future de~reiopment. The easement would not-be <br />utilized until there was a need for it. other than. possibly curso~w ~'adin~ for the d~veWay <br />purpose. Once there is City sewer and wa~er a~railab}e the easement would be opened up if the <br />land is developed fur*~her. His ?ostrich is that if ~hat were to take place.~he developer would bear <br />the costs of put~ing d~ose assessments in. <br /> <br />Mayor Gamec commented the driveway would remain as a ~¢avel mad until .there was to be any <br />further development that would take place. <br /> <br />Councilmember Z:,mmerman stated Mr. Dusbabek is willina to sell an easement to Mr. Bauer, <br />but the K. aas par~y is not. He does not think he would be in favor of condemning one.person's <br />land for the sake of someone else. <br /> <br />M_;. Dusbabek stated l~e does not want more trees corning down. He would be willing to sell to <br />the City, but not a pp~va~e puny: that is the only way to do this in a timely time frame to keep the <br />road from coming in behind hirn and impactin~ him further. I~~ Mr. Bauer is forced to put the <br />road in through the north, he would not have an interest in sellin~ that easement. <br /> <br />Mrs. I4.aas stated it is being said that there needs to be a road easement, but Mr. Bauer is saying <br />the land' may never be developed. <br /> <br />Counciimember Cook replied the City cannot ~o by Mr, Bauer's opinion~, as he may not even be <br />a resident there in J:~ve years. They need to correct this problem now, and they'aiso need <br />east/west routes in the City. if they do not take care of this it will cause a problem in the future. <br /> <br />Mrs. Kaas stated as i'ar as this being an east/west route, almost eve~,'ything behind them is <br />wetlands. <br /> <br />Councilmember Strommen questioned why the City would have purchased an easement past <br />their property. <br /> <br />Assistant Pubiic Works Director Olson replied ii' there would have been a subdivision request the <br />easement would I~ave been required as pm-t of their property.
