She noted in her estimation this suggestion would address, <br />the problems, such as the width of the road that would impact the Kaas later, Mr. Bauer having <br />access to his property without further expense, and the Dusbabeks having too. re trees removed <br />from their property. <br /> <br />Mayor Gamec stared.the problem with this suggestion is i~f they do something temporary, they are <br />asking for more problems in the furore. He does not like long di-/ve,,,zays necessarilY~.:.but he <br />thinks eventually there would be a street there. His personal feeling would .be to negotiate':.~th <br />the property owners and ~et an easement through the particul:ar':area, just doin~ a drivewav:::and ~' ::;.' <br />not paving that street. The City, would have the easement,.:'but, the .street would not be paved!:::: <br />With an}, future development the street would ther~ ha~e to be blacktopped. He stated Mr:;i:; <br />Dusbabek put it. in a good way; they want resolutiom. Sc;me decisions are not the most <br />but he thinks that would be the best way to handle:this particular:project. He would not lik~' to <br />see the street blacktopped or finished at this time; :it W6uld look almost like a private driveway. <br /> <br />Councilmember Cook concurred. He stated with the original a~eement they allowed a driveway <br />to *,o throush on a road easement. This should be worked out:now rather than in the future. <br /> <br />Motion by Councih-nember Cook, second by Mayor Gamec, that :the Ci~'move forward with <br />negotiations to purchase the road' easement through the Kaas and Dusb.abek properties at 160"' <br />Lane and, if necessary, to authorize condemnation. ;: ' <br /> <br />Further Discussion: Councilmember Strommen indicated she,would like to hear the reaction of <br />the property owners to Councilmember Kurak's proposal, Which had some creative thinking for a <br />problem that has no good solution. Regarding Councilrneml>er Cook's statement of working this <br />all out now, she does not think it is a problem not to totally resolve the easement at this time. <br />Development may not happen for a long time and they do not have to totally close this out. She <br />thinks Councilmember Kurak's proposal is a good one to consider and she would like to hear <br />more discussion amongst the Council before it is ruled out. <br /> <br />Greg Bauer. 6017 - 1~57~h Avenue NW, stated he understands the dilemma as far as the easement. <br />He could see that the easement would be acquired with some sort of agreement that there would <br />not be development for a certain period of time, and the easement would just be used for a. <br />driveway for the time being. <br /> <br />Councilmember Cook stated he would like to see the Council go ahead with his motion, and <br />agreements relating to the easement would have to be worked out with the property, owners. Mr. <br />Bauer would have to develop his property for the City to want to put a road tl~rough there. <br /> <br />M.r. Bauer replied that is possible, and people do not need to think that as soon as this were to <br />happen there would be an expectation of a road running through there. <br /> <br />Councilmember Cook indicated if the City went tlzrough ~vith this action they could negotiate <br />something with Mr. Bauer financially tbr having the driveway there, but that would be separate <br />from this. <br /> <br />Councilmember Pearson asked how large Mr. Bauer's parcel is, and how much is buildable. <br /> <br />CiU Council/July 27, 2004 <br />Page 13 of 34 <br /> <br />'-289- <br /> <br /> <br />
