CASE #: ~ <br /> <br />REQUEST FOR FINAL PLAT REVIEW OF ALPINE ACRES 3rd ADDITION; <br /> CASE OF OAK CREEK BUILDERS <br /> By: Megan Wald, Associate Planner <br /> <br />Background:, --. <br /> <br />Oak Creek Builders has applied for final plat approval of Alpine Acres 3rd Addition consisting of <br />61 townhome units. The property is generally located in the triangular area formed by Nowthen <br />Blvd., Sunfish Lake Blvd., and Alpine Drive. <br /> <br />The following items are enclosed for your review: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site location map <br />Final Plat <br />City Staff Review Letter dated July 23, 2004 <br />Resolution approving the final plat <br />Proposed Development Agreement <br /> <br />Notification: <br />State statute does not require notification of applications for final plat approval.. <br /> <br />Observations: <br /> <br />The preliminary plat approved by the City Council on June 24, 2003 consists of 200 townhouse <br />units and two existing single-family homes. The third phase of Alpine Acres conforms to the <br />approved preliminary plat. The Final Grading Plans, Construction Plans and Specifications have ' <br />been reviewed by the City Engineer and are acceptable. <br /> <br />Park dedication, trail fees, and storm water management fees for the third phase will consist of a <br />cash payment. <br /> <br />The City recently established an ordinance adopting MN State Building Code Amendment 1306. <br />A portiori of the amendment requires residential dwelling structUres over 8,500 square feet in <br />size to install a fire sprinkler suppression system. The ordinance became effective on July 23, <br />2004. The effective date established in the ordinance relates to receipt of building permit and <br />does not address situations where subdivisions contain established streets and infrastructure and <br />building permits have not been received. This is the case for Alpine Acres 3~d Addition, a <br />significant portion of the streets and infrastructure is already constructed within the third <br />addition. In order for Alpine Acres 3rd Addition to comply with 1306, the existing streets will <br />have to be removed, infrastructure resized, and streets reconstructed. Staff does not see the <br />advantage of distUrbing existing streets and infrastructure; therefore in situations where a <br />residential structure is located adjacent to existing streets and infrastructure tha~ was installed <br />prior July 23, 2004, staff suggests that the City waive the amended t306 compliance <br />requirement. <br /> <br />-303- <br /> <br /> <br />
