170.014 GFNERAL REGULATIONS FOR ALL DISTRICTS <br /> <br />170.014A NON-CDNFORMING <br /> <br />The following provisions shall apply to all non-conforming uses.: <br /> <br /> 1. · A non-confirming use may be continued, but may not be <br />extended, expanded, or changed unless to a conforming use, except as <br />permitted by the Board of Adjustment in accordance with the provisions <br />of this chapter. <br /> <br /> 2. A zoning certificate must be obtained within sixty (60) <br />days after notification to the zoning officer by the owner of any <br />non-conforming use as evidence that the use lawfully existed prior to <br />the adoption of the provision which made the use non-conforming. <br /> <br /> 3. Any non-conforming structure damaged by fire, flood, <br />explosion, or other casualty may be reconstructed and used as before <br />if such reconstruction is performed within twelve (12) months of such <br />casualty, and if the restored structure has no greater coverage and <br />contains no greater cubic content than before such casualty. <br /> <br /> 4. In the event that any non-conforming use, conducted in <br />a structure or otherwise, ceases for whatever reason for a period of <br />one (1) year, or is abandoned for any period, such non-conforming use <br />shall not be resumed. <br /> <br /> 5. Normal maintenance of a non-conforming structure is <br />acceptable, including non-structural repairs and incidental mainten- <br />ance. <br /> <br /> <br />
