5/7/79

Item'#3, Arthur St;'Hilaire
Mm. Hilaime wished a Special .use permit to repair cars in a residential
garage at 15428 Nowthen Blvd. Mm. Hilalre Stated that if the only concern
of the neighbors was visibility of the site, he would be building a two or
three car gamage elsewhere onthe property and would be working on mostly
curment models with an occasional older'w~ecked cap. Mm. St. Hilaire
stated that he didn't want to fom&e anything on'anyone, but that he has
never had complaints from his present neighbors. It was pointed out to
Mr. St. Hilaire that he would have neighboms just as close here as he does at
his present location.

Ken Peterson asked fop commission comment, and Mm. Dunn stated that he feels
the City has enough of this type of'business in residential areas, and they
have found out that gmanting c.u.p, just doesn't work citing an example
on Hematite Street which has caused concern to the City. Kathy Schneider
stated that it would be too'hard to Set conditions which would cover all the
possible pmoblems which could amiss.
MotiQn by Art Dunn, seconded by Gerry Zimmerman to recommend to the City Council
to deny the request of Mm. St. Hilaime for'a C. U. P. at 15428 Nowthen Blvd.
due to the following findings of'fact:
1.) The amea is currently zoned R-1.
2.) The pamcel involved'is extremely open and exposed to the adjacent property
ownems view'without natupal screening and artifical scmeening would detract
from the area.
3.) Accomding to Mm. St. Hilaire there is noticeable noise and long hours.
Motion cammied 7-0.

Item #4 William Proft - Home Occupation Permit Discussion

Mm. Proft was present to ask the Commissions feelings on his request fop
a special use permit to operate a one man sign business out of a garage
on Hwy #10 (8964) . Mr. Proft was advised to request a Public Hearing if
he desired to proceed and if possible have pictures of present site and
any information regarding present neighbors additude.

Item #5. Ed Klemish Proposed'subdivision
Mm. Klemish was present with'a revised sketch plan of a proposed development
Adjacent to Shady Lawn Estates on the Nomth. Mr. 'Richamd Cich, 6440 170th N.W
stated that he was opposed to Mm. Klemish not meeting the 2.5 acme lot size
requimement and that he didn't feel rheim roads could handle the extra traffic.
Ken Peterson stated that this was not a Public Hearing and that now Mm. Klemish
would be aware of their concerns.

Kathy Schneider stated that this was not close enough to the P & Z Commissions
original recommendation of consideming lots that were close to the 2.5 acre
requirement. Mr. Jeff Cains stated that this sketch was close to what the
Council had recommended. Peter Raatikka stated that the Council had told
M~. Klemish that they would like to see total density of 2.5 acres.

Mm. APt Dunn questioned who came up with the 2.5 acre density factom for this
plat pointing out that the developems of Tiemra Estates would pmobably have
benefitted fmom the same and where does the Commission dmaw the line.

Mm. Klemish replied that this was a special situation since the City wanted
pamk land along the brook~ Gerry Zimme~man stated that if we give a variance
in this case, we will be hard p~essed to turm others down.
