P¢ Z-2- <br />5/7/79 <br /> <br />Motion by Ron West, seconded by Gerry Zimmerman to approve the minutes of <br />4/19/79 regarding the choosing of replacements for the vancacies on the <br />Commission as read. Motion carried 4-0. Kathy Schneider, John Hubbard, and <br />Ben Deemer abstained. <br /> <br />Item 1. Arthur Anderson ~ Preliminary'Plat <br />Ron West asked Peter Raatikka if he had been of the land dispute, and Mr. <br />Raatikka that it would have been checked out by the attorney,before approval. <br />Kathy Schneider asked Mm. Raatikka to ~espond to a statement made by a resident <br />at the Public HeaPing that the ~oads would not handle additional traffic. Mr. <br />Raatikka stated that he found the road adequate for the one new lot being created. <br />Pon Westaasked if Mr. Anderson would have to upgrade Bison or the 171st Street N.W. <br />Ken Peterson explained that in exchange for the land, the City will handle 171st. <br />Ben Deemer asked about the school bus situation~ and a lady fmom the hearing <br />stated that the bus turned around in her driveway, but that she didn't mind. <br />Ken Peterson pointed out that this was probably illegal and a new owner could always <br />protest. <br /> <br />Motion by Ron West, seconded by Ben Deemer to recommend to the City Council to <br />g~ant approval of the preliminary plat for Arthur Anderson subject to the <br />following: <br />1.) City Attorney show that a clear and marketable title exists due to the <br /> mentioned land dispute with cost to developer. <br />2.) Variance be granted on'item #2 of 5/7/79 engineer's report referring <br /> to a topographic map, profiles and widths of existing roads, and proposed <br /> method of disposing of drainage being provided as required by City Code <br /> since theengineer reports the existing road and ditches appeam adequate. <br />3.) Variances be granted regarding soils information as required by City code <br /> (170.037 Bi) and regarding inspection of'lots by City's plumbing inspector <br /> (170.038H).as the engineer reports the soils are suitable for soil absorp- <br /> tion systems. <br />4.) Payment of Park fee. <br /> <br />Motion carried 5-2. Gerry Zimmerman and Art Dunn opposed. Mr. Zimmerman <br />stated that he is opposed to granting variances on deficient size lots. <br /> <br />Item 2. Pondvale Preliminary Plat'Approval <br />Motion by Ron West, Seoonded by Kathy Schneider to table the recommendation <br />until the developer can meet with the Dngineer to work out the deficiencies <br />as noted in his letter of 5/4/79. Motion carried 4-2. Art Dunn and Ken Peterson <br />opposed, Ben Deemer abstained. <br /> <br />Kathy Schneider stated that she seconded the motion for discussion, and Ben Deemer <br />asked why his requests for variances were not mentioned in the Engineer's letter?. <br /> <br />Art Dunn stated that there should be more time between a developer receiving the <br />engineers letter and the'meeting so Some of these things can be ironed out. <br /> <br />Lloyd Schnelle explained the time factor some developers face, and Kathy Schneider <br />stated that if they know'they have to get these things done, they'll get their <br />act together. Ron'West stated that he felt the developed should have gotten <br />together with the engineer to See if some ofthe variances couldn't be avoided. <br />There was a discussion regarding allowing a less rough sketch plan, and it was <br />the concensus of'the commission~that Chairman Peterson'and Mr. Schnelle confer <br />on plats that have problems that should'be addressed before being brought to <br />the Commission <br /> <br /> <br />
