Schnelle
City Attorney Goodrich
City Engr. Raatikka

Chairman Mickelson called the meeting to order at 7:40 P.M. & led Pledge to Flag.

He announced the purpose of the Board of Adjustment hearing is to
consider a request from Mr. Sherwin Shenk for a variance to subdivide by
metes and bounds.

Mr. Shenk was present with Mr. Paul KYYhkynen, his attorney.

Mr. Kyyhkynen pointed out to the Council the piece of property in question
which consists of a parcel of land which is less that 2% acres lying on
the easterly portion of Mr. Shenk's homestead. The property fronts on Highway
10 and the rear of the property abuts the railroad track. He stated that
Mr. Shenk has already sold this parcel to a gentleman who is using the
property to store cars and plans to construct a building and operate a car
sales business on this .parcel in the future.

Councilman Reimann questioned if a car sales if the best use for the property
and if it would add to traffic problems.

Mr. Kyyhkynen said it is compatible to anything else being sold in that
vicinity at present.

Mayor Gamec mentioned the fact that some easement should be provided in the
front and/or back for a future service road since other parcels along Highway
10 have been required to dedicate-such easements.

Councilman Cox asked Mr. Kyyhkynen to comment in regard to Mr. Shenk not being
aware of the City's subdivision ordinance.

Mr. Kyyhkynen said Mr. Shenk wasn!t aware of the subdivision ordinance and that
a year ago he sold a piece of his property to Mr. Kovar without going through
the subdivision process.

Councilman Cox reported that at the time of the Kovar incident, Mr. Shenk was
informed at that time of the City's subdivision policy. It was suggested to
him then that for his own benefit, he might want. to go ahead and provide a
plat for his land.
