Page 2 <br />Board of Adjustment <br /> May 14, 1979 <br /> <br />Mr. KYYhkynen said it was Mr. Shenk's understanding that the Io~ size requirement <br />was one acre. <br /> <br />Councilman Cox said at the time the City considered the Kovar parcel, the City's <br />requirements on subdivision were thoroughly discussed with Mr. Shenk by both <br />Planning and Zoning and City Council. It was explicitly brought to his attention <br />so that there would be no question in his mind as to what is required to <br />avoid his having any future problem with his land in this regard. <br /> <br />Councilman Cox reiterated that when Council granted the variance request <br />for Mr. Shenk to sell a piece of property to Mr. Kovar, that in reviewing <br />that matter, it was discussed with him that in his better interest in <br />accord with the ordinance that he do whatever appropriate for the rest <br />of his property in order to provide an orderly plan for his property and <br />access and right of way to Highway 10 in a reasonable manner. It was <br />suggested he consider the importance to the City of having businesses <br />that provide a good sound tax base and 'good practical use .of the property <br />for everyone involved. <br /> <br />Mr. Kyyhkynen said Mr. Shenk has an odd shaped piece of property and there <br />is no other way to subdivide it. <br /> <br />Mayor Gamec expressed concern that provision be made for a future service <br />road to insure uniform traffic patterns as developments occur along Highway 10. <br />He asked Engineer Raatikka what size easement has been taken' on the Kovar parcel. <br /> <br />Engineer Raatikka replied that he couldn't say for sure without researching <br />the matter but guessed that 50 feet would be adequate. <br /> <br />Mr. Kyyhkynen said.that the parcel in question did not have access to <br />the Highway at the present time, access to the parcel is now through Mr. <br />Shenk's driveway. Mr. Shenk said that the State Said he could have access <br />for this parcel on Highway 10. <br /> <br />Motion by Mayor Gamec and seconded by Councilman Reimann to table further <br />Board of Adjustment proceedings on this case until May 29, 1979 so that <br />the City dan research and determine the size of the adjoining easements <br />so that an easement can be obtained from. this parcel to line up with the <br />surrounding property and allow time to secure some suggestions in regard <br />to accesses on Highway 10, and said accesses to the property should only <br />be from the easter!y direction and exits only to the west. <br /> <br />Motion carried. Voting yes: Mayor Gamec, Councilmen Mickelson, Reimann <br />and Sorteberg. Voting no: Councilman Cox. <br /> <br />Councilman Cox said he feels this 'case is similar to VemMcGregor's and since <br />the City is requiring a plat in her situation, along with cases of Anderson <br />and Westby, this case should also be platted, and that would assure that all <br />requirements of the ordinance will be met. <br /> <br />Councilman Sorteberg said the same requirements can be obtained by metes <br />and bounds. <br /> <br />Councilman Mickelson added that everything ~uld be addressed either way. <br /> <br /> <br />
