FROM: <br /> <br /> TO: <br />SUBJ: <br /> <br />City Administrator <br /> <br />Mayor and Council <br /> <br />Critique on following Board of Adjustments <br /> <br />Encl: (D4-a) Public Heari~ notice and application <br /> <br />CASE #1 SHERWIN SCHENK REQUEST FOR LOT SIZE VARIANCE IN INDUSTRIAL ZONING <br /> <br />IN TRANSITIONAL AREA: <br /> <br />Background Information: The following background information is <br />submitted on this problem case: <br /> <br />a) Sherwin sold a piece of land containing 1.6 acres to ~gr. A1 <br />Johnson which was subdivided by metes and bounds. <br /> <br />b) He needs a variance on lot size as the current industrial <br />zoning in transitional area requires two and one-half acre lot <br />sizes. <br /> <br />c) If he gets this variance from the Board of Adjustment, he will <br />have to get another variance from the CityCouncil to subdivide <br />by metes and bounds. <br /> <br />d) Enclosure (D4-a) Planning and Zoning minutes are submitted <br />for your information (Please refer to your agenda of May 14, 1979) <br /> <br />e) Enclosure (D4-b) contains survey of metes and bounds sub-' <br />division of land (Ple'aSe refer to your agenda of May 14, 1979) <br /> <br />f) Currently, Mr. Johnson uses this parcel of land to park auto- <br />mobiles. The parking of the automobiles is not in violation of <br />the ordinance. However, if he wants to use it as a sales area <br />then he would be in violation of the ordinance. Also, if he used <br />it as a place to park junked cars, he would be in violation of <br />the ordinance. -~ <br /> <br />Board of Adjustment Action: Your action will be wehther to grant <br />platting by metes and bounds or to plat in accordance with the <br />subdivision code. In any of the above cases, however, you rule, <br />he will have to return to the Planning Commission. Also, he <br />needs a variance from the two and one-half acre lot size. <br /> <br /> <br />
