Please <br />refer to Enclosure B-4 page 8 Planning and Zoning minutes dated <br />June 4, 1979 for their request. <br /> <br />CASE #6: PETER HERRICK REGARDING BUILDING PERMIT FOR RESIDENTIAL DWELL- <br /> <br />ON A METES AND BOUNDS PARCEL OF LAND: <br /> <br />Background Information: The following background information <br />is submitted on this case: <br /> <br />a) Enclosure (D3-e) contains a certificate of survey of the <br />10.0 acre parcel of land that Herrick's purchased from Progressive <br />Homes. <br />b) Enclosure (D3-f) contains a sketch of the total parcel of <br />land prior to a subdivision bymetes and bounds which Progressive <br />Homes did on this.total parcel. <br />c) Enclosure (D3-g) contains the Planning and Zoning recommend- <br />ations on this metes and bounds subdivision of land. <br />d) Enclosure (D3-h) contains the.Board of Adjustment minutes <br />dated February 26, 1979 and Council minutes dated February 26, <br />1979 which addressed this total 40 acre parcel of land which con- <br />tains the Herrick's parcel of land. <br /> <br />Comments: The Herrick's maintain that their 10 acre parcel of <br />land meets all the criteria of State and City codes in that <br />they have the required road frontage and the law provides for <br />metes and bounds subdivision of land of five acres or more. <br /> <br />I have discussed this with the City Attorney and he states we <br />are hard pressed here to refuse a building permit. However, I <br />think this should be discussed again with the City Attorney in <br />reference to the Holker case that is currently in litigation. <br /> <br />In view of the above, if you do authorize th~ issuance of a <br />building permit, we had better have language entered into w~hich <br />would be part of their deed stating that if they ever desire to <br />subdivide this parcel of land they would have to provide a <br />frontage road so that there is only one ingress and egress from <br />the subject parcel. <br /> <br />CASE #7: INDUSTRIAL REVENUE BOND REGARDING GREENBERG AND GROSSLEIN: <br /> <br />The firm that is representing Greenberg and Grossleinwill be <br />with the appropriate resolution for you to adopt. These <br />resolutions will be available at the meeting. <br /> <br />CASE #8: M & L LIQUOR REGARDING SITE OF OFF-SALE LIQUOR STORE: <br /> <br />Mr. Gary ~artinson will be present to discuss this matter <br />with the City Council about a different location for the off- <br />sale liquor store. <br /> <br /> <br />
