of time it takes to develop this ordinance change they are re-
questing iterim authority to accomplish the above. Presently,
the City has this authority in a very limited situation. Please
refer to Enclosure B-4 page 8 Planning and Zoning minutes dated
June 4, 1979 for their request.

CASE #6: PETER HERRICK REGARDING BUILDING PERMIT FOR RESIDENTIAL DWELL-

ON A METES AND BOUNDS PARCEL OF LAND:

Background Information: The following background information
is submitted on this case:

a) Enclosure (D3-e) contains a certificate of survey of the
10.0 acre parcel of land that Herrick's purchased from Progressive
Homes.
b) Enclosure (D3-f) contains a sketch of the total parcel of
land prior to a subdivision bymetes and bounds which Progressive
Homes did on this.total parcel.
c) Enclosure (D3-g) contains the Planning and Zoning recommend-
ations on this metes and bounds subdivision of land.
d) Enclosure (D3-h) contains the.Board of Adjustment minutes
dated February 26, 1979 and Council minutes dated February 26,
1979 which addressed this total 40 acre parcel of land which con-
tains the Herrick's parcel of land.

Comments: The Herrick's maintain that their 10 acre parcel of
land meets all the criteria of State and City codes in that
they have the required road frontage and the law provides for
metes and bounds subdivision of land of five acres or more.

I have discussed this with the City Attorney and he states we
are hard pressed here to refuse a building permit. However, I
think this should be discussed again with the City Attorney in
reference to the Holker case that is currently in litigation.

In view of the above, if you do authorize th~ issuance of a
building permit, we had better have language entered into w~hich
would be part of their deed stating that if they ever desire to
subdivide this parcel of land they would have to provide a
frontage road so that there is only one ingress and egress from
the subject parcel.

CASE #7: INDUSTRIAL REVENUE BOND REGARDING GREENBERG AND GROSSLEIN:

The firm that is representing Greenberg and Grossleinwill be
with the appropriate resolution for you to adopt. These
resolutions will be available at the meeting.

CASE #8: M & L LIQUOR REGARDING SITE OF OFF-SALE LIQUOR STORE:

Mr. Gary ~artinson will be present to discuss this matter
with the City Council about a different location for the off-
sale liquor store.
