Mayor Gamec concurred that the liquor license should be readvertised.
M & L ~iquors indicated that they didn't want to readvertise and take a chance
on losing their license but they have already been waiting for seven months for
Mr. Cable to get started.

Councilman Cox stated that when they came before Council with the liquor license
request they indicated at that time that Mr. Cable had this all put together.

Mayor Gamec informed them that the only thing they can do is surrender the
liquor license and readvertise the liquor license opening again.

FAITH BAPTIST CHURCH LAWSUIT

Attorney Goodrich stated that he has to answer to interrogatories which
the City must. submit to the plaintiff's attorney.
Discussion was held.

TUNGSTEN AND FRONT STREET STORM SEWER PROJECT

Motion by Councilman Reimann and seconded by Councilman Cox to authorize the City
Attorney to proceed with condemnation proceedings to acquire the storm sewer
easement of 20 feet through Lot 3 Dickenson Mississippi Estates.

Motion carried. Voting yes: Mayor Gamec, Councilmen Cox, Mickelson, Reimann
and Sorteberg. Voting no: None.

Mr. Post, who owns the Sunset Motel and is part of this drainage project, also
one of the signers on the petition, appeared before Council stating he doesn't
want to be part of the project due to the costs involved. He said he is the
3rd highest assessed cost and he has no benefit and doesn't contribute to the
drainage problem. He knew that Mr. Grosslein had a problem with drainage and
signed the petition to help him.

Mayor Gamec stated that there has been a drainage problem in this area.

Mr. Grosslein indicated that Mr. Post had signed a blank petition and did not have
a chance ~o come to the meeting and he can see' his point and that Engineer Raatikka
should check to see how much water does come off his land onto Tungsten.

Engineer Raatikka said it appears that a lot of Mr. Post's drainage goes onto
Grosslein property.

Mrs. Dickenson said she feels if the ditches and culverts were repaired there
would not be a problem.

Councilman Cox said a determination should be made for proportionate payment
of benefitting property owners.

Engineer Raatikka said he could take a topo study and review the spreading of
costs to see if there is no watershed from Mr. Post's property onto someone
else's property.

Administrator Schnelle stated that all petitioners were 'notified prior to the
5/29/79 meeting for this improvement. And, that the petitioners stated that
100 percent of the people involved for the project were on the petition.in favor
of the project. They were all notified so they could be at the meeting.

-il-
Regular City Council Meeting.
6/11/79
