Wt3E}.'.E/~S, Ra~mey desires the seradces of the fire department o£ Elk River <br />in case of fires ocm~rring in the City of Ramsey, located outsfi_de the corporate <br />limits o£ 7~,lk Eib'er, and <br /> <br /> i',~;.i?j.-~'E~,S, Ra:r, sey desires the set-rices of the fire department consisting of <br />¥o]unt(:er fire;:.en, at ]cast one (1) p~mv,ping en~ne and miscellaneous ot~er <br />equip;~mnt, which pcrsormel and eq~pment are available, subject on~ Lo the <br />]imltat~ons herein expressed, for fighting fires in said Ramsey and elsewhere, <br /> <br />IT IS T}~E?EFORE AGREKD BY /~'~ BE%'~_~ SAiD PAaRT_TES AS FOLLOWS: <br /> <br /> 1. That Elk River through its fire department will answer calls to <br />fight fires occurring in-the City of Ramsey in the area designated on <br />schedule A with at least one (1) pub, ping eno~ne and equipment to deliver at <br />least 1,500 gallons of water and such volunteer firemen' as may be designated <br />by the Chief or the Elk Yaiwer Fire Deferment, or YJs Deputy, unless in the judgment <br />of saJd Chalet, or Deputy, such fire can be fought vgth other eq'mipment maintained <br />by Elk River as part of its fire depa~$ent, subject only to the limitations and <br />restrictions hereinafter set fo~h: <br /> <br />if road and weather conditions at the time of the call be such <br />that the fire rmm cannot be made ~ith reasonable safety to men <br />and equipment and the decision of the Fire Chief or his Deputy <br />in charge shall be final in such matter, no obligation arises <br />under this agreement on the part of Elk RiYer to answer such call. <br /> <br />In the event that a sufficient- amount of the Fire Fighting <br />Equipment and nmmber of volunteer firemen, or both, are <br />co~itted at the time of the fire ca!l, in the sole judgment <br />of the Chief or his Deputy, to fighting pre-existing fire <br />elsewhere, or providing fire protection because of pre- <br />existing fire, so as to render the ~vailable fire~mgnomng~' ~ ~' <br />equipment and volunteer firement inadequate to answer the <br />fire ca!l, in Ramsey and fight the reposed fire, no <br />obligation arises under this agreement to &nswer such call, <br />and no person or party shall have recourse against Elk P~ver <br />for refusal to answer such call. A pre-existing fire for the <br />purposes of this agreement shall be a fire to which the fire <br />department of Elk River is called previous to receiving the <br />call from Ramsey and which fire is still being fought by <br />Elk River fire deparlmont at the time the call from Ramsey was <br />received. <br /> <br />In the event the Elk River Fire Depa~ment is fighting a building f{re' <br />in the City/Township of Ramsay and a fire breaks out in the City of <br />Elk River, the Elk River Fire Department will nOt leave the City/Tovmship <br />of Ramsey fire unattended. The Elk PCver Fire Department will et%her <br />remain to fight the fire or ~i]_t provide services from another municipality <br />through ~tual aid agreement. <br /> <br />The decision of the Fire ~hief or his Deputy ~ith reference to <br />sending or recalling fire fighting equipment and volunteer fire- <br />men to or from any fire in Pmmsey shall be firml and no person <br />or party shall have reco~se against Elk P~ver for any damages or <br />losses resuZting from such action or decision. <br /> <br /> 2. That P~msey shall pay to Elk. River each year tb~s agreement is in <br />force and effect, a sum of money equivalent to one mill on the assessed <br />valuation of property in the City of Ramsey, in the area covered by this <br />contract. In addition thereto, Ramsey shall pay to the City of Elk River monthly, <br />d'~ing the term of this agreement, for all fire calls in Ramsey' answered <br />by ELk River Fire Department, on time invoices cer~oified by the Chief or his <br />Deputy, a sum equivalent to $225.00 per run for the first half hour of each <br />call and $75.00 for each subsequent half hour or fraction thereof of each call. <br /> <br /> 3. The payment specified in paragraph 2, above, shall be made by ~amsey <br />for any fire call in Ramsey answered by Elk River Fire Depa~ment regardless <br />of how the call is received or by whom it is ~de. No payments shall be due for <br />false ala~mms unless the call is made by a resident of Ramsey. <br /> <br /> <br />
