CASE #9: <br /> <br />CASE #10: <br /> <br />CASE #11: <br /> <br />City Administrator's Comments: ~y opinion hasn't changed on <br />this matter since I put it on the May 14, 1979 Council agenda <br />and when Council took their action on May 29, 1979 and June 11, <br />1979. <br /> <br />After reviewing the contents of enclosure (D2-i) and (D2-j) and <br />(D2-k) I am of the same opinion still that Mr. Aydt has only <br />zoning for non-conforming use. As according to your Compre- <br />hensive Plan, UMB-2 zoning was meant to be used for non-con- <br />forming uses. <br /> <br />Frankly, my only really concern is that Council fully under- <br />stand what they did with the zoning on this at your May 29, 1979 <br />meeting. <br /> <br />TUNGSTEN AND FRONT STREET S~OHM SEWER PROJECT REGARDING THE <br /> <br />POST PROPERTY: <br /> <br />Council requested the City Engineer to review the Post property <br />as to benefit he would receive from project. Accordingly, en- <br />closure (D2-1) City Engineer's letter dated July 20, 1979, is <br />furnished for your information. <br /> <br />IMPROVEMENT PROJECTS 78-1, 2, 3, & 4 REGARDING LIQUIDATED <br /> <br />DAMAGES: <br /> <br />This is probably your first involvement for liquidated damages <br />in regards to public improvement projects. Enclosure (D2-m) <br />City Engineer's letter dated July 19, 1979, is stating you could <br />levy liquidated damages against the contractor for this project <br />in the amount of $5,000. <br /> <br />Comments: This is strictly a City Council decision to levy <br />the full amount or actual out of pocket costs. In this case, <br />I would recommend full amount due the neglegence on the con- <br />tractor's part with this project. <br /> <br />BURLINGTON NORTHERN CROSSING ON SUNFISH LAKE BLVD. - INFORMATIONAL <br /> <br />ONLY: <br /> <br />This is for your information only -- Burlington Northern will <br />be closing Sunfish Lake Blvd. beginning on Wednesday, July 25, <br />1979 for about three to four days to make repairs to the cross- <br />ing. <br /> <br /> <br />
