Anoka, Minnesota 55303 Re: Improvement Projects 78-1, 2, 3, & 4 Dear Council Members: The contractor on the above referenced projects, N.D.H, Inc., has completed the projects in accordance with the contract documents and technical specifications with the exception of meeting the completion date. The original completion date for the projects was December 6, 1978. However, due to the lack of suitable weather last construction season, the completion date for the projects was revised to May 28, 1979. Improvement Projects 78-1, 2, & 3 were initially completed by the revised completion date; however, Improvement Project 78-4, Whispering Pines Estates, was not initially completed until June 22, 1979. The delay in completing the project resulted in additional work for our firm and added costs to the 'project. Section 15 of the general conditions in the contract documents and' technical speci- fications states that if the contractor fails to complete the work within the contract time, then the contractor will pay to the owner the amount of $200.00 for each consecutive calendar day thereafter as liquidated damages. In the case of Improvement Project 78-4 the City could assess the contractor $5,000.00 in liquidated damages. If you have any questions regarding the projects, please let us know.
