A new section'to be known as Section 170.0112 and titled PAY~NT OF EXPENSES INCURRED shall be added to the zoning chapter and it shall read as follows: 170.Ol12 PAYMENT OF EXPENSES INCURRED Ail costs incurred by the City in processing an application for a Conditional Use Permit, Temporary Conditional Use Permit, Variance issued by the Board of Adjustment and ~mend- ments to this zoning chapter shall be paid by the applicant. Said costs shall include but not be limited to the following: P~ofessional consulting services as directed by the City Council, Board of Adjustment and/or Planning Commission, Xerox copies, 'extraordinary City Staff involvement, public hearing publications, and written notice to adjoining prop- erty owners. A set fee established from time to time by the City Council shall be deposited with the City at the time the respective application is made. At the ~ime the appli- cation is made, if the zoning officer determines that costs in addition to ..the set fee required by the City Council will likely be incurred by the City then an additional sum as determined by the ~.oning Officer shall be deposited with the City. ~y part of the funds deposited not expended by the City shall be returned to the applicant after final action on the application. g) Section 170.019B Paragraph 3 PROCEDURE shall be amended to read as follows: The Planning and Zoning Commission shall hold the required public hearings instead of the City Council regarding zoning amendments.
