... and the Public
protection

Officials
Liability

Insurance

Stewart Smith's Public Official Liability Program can help Public Officials protect
themselves against many of these hazards. The main features of this broad coverage
are summarized below:

[] THE INSURED The policy will be held by the public entity to which the Official
belongs, but coverage extends to
· The public entity itself;

· All elected or appointed officials or members of commissions, boards or units
operating under the jurisdiction of the public entity;
· All full-time employees, defined as those working at least 20 hours per week.
· The estates, heirs, legal representatives or assigns of deceased persons who
were insured at the time of the wrongful act.
and now coverage is extended to all Attorneys, Architects, Engineers and Accountants
while acting in the scope of their professional duties as employees of the public
entity. And because the policy is held by the public entity itself, new officials or
employees are automatically covered at no additional premium charge.

[] THE COVERAGE The policy will pay on behalf of the Insureds for any loss resulting
from actual or alleged "Wrongful Acts" committed by the Insured, provided the
claim is first made during the policy period.
· Wrongful Act is defined as any actual or alleged error or misstatement or act
or omission or neglect or breach of duty including misfeasance, malfeasance,
and non-feasance by the Insureds in the discharge of their duties with the
public entity, individually or collectively, or any matter claimed against them
solely by reason of their being or having been In~ureds.
· Loss is defined to include not only damages and settlements but also legal
fees incurred as cost of investigation and defense of legal action.

· Claims First Made. The policy covers all claims first made during the policy
period, including claims arising from unknown prior acts.

[] AVAILABLE TERMS · Twelve Month policy period.

· Limits from $1,000,000 annual aggregate.
· Deductibles vary depending on the size of the public entity.

This Brochure describes in general terms the essential features of this policy. In no way
does this Brochure alter the terms of the policy.
