TO: Mayor and City Council

FROM:

City Administrator

RE: Council Old Business

Enclosure (D2-a) Council m~nutes, dated January 23, 1979

CASE #1:

ACCESSORY BUILDING REQUEST FOR; CASE OF STANLEY BROWNING AT
HIS ADDRESS OF 8231 - 158th AVENUE N.W.:

CASE #2:

.Mr. Browning is requesting a permit for an accessory building
to be located at the above address. He has a one (1) acre lot
which would permit him to build an accessory building up to
624 square feet. Inh,~shas he has two sm~ll out buildings
which totally consist of approximately 150 square feet. So
~r. Browning would be authorized an accessorY.building of 474
sq~mre feet. .-

Problem: We would normally .grant this permit in accordance
with the ordinance without comauE to the Council: However, we
have had numerous z6ning complaints regarding Mr. Browning. The
complaints.have pertained to the storage of vehicles and other
auto debris in his yard. It appears Mr. Browning is in the
auto repair or Junk business as a second occupation.

Now, I did a drive by visual inspection of his property on
Wednesday after-noon, June 6, 1979, and there were two trucks,
one pickup, one tractor, and two cars on his premises plus
other material. He h as made an improvement'overmy last visit
which was in the spr~ng with the City Attorney. However, he
still has a problem with zoning and the granting of the accessorY
building will further perpetuate this problem.

Comments: We have discussed this zoning ProblemwithMr. Browning
numerous times so he is Well aware of-it. We don't feel he
should get approvslforanaccessorYbuil~g for the reason
stated above ~ntil he cleans up his act.

JOHN L.
