SECTIONS 18-20. (County and Municipal Agricultural Preservation Plans) <br /> <br />Provides for creation of agricultural preserves outside of the Metropolitan <br />Area. Basically a county or municipality adopts a special agricultural <br />preservation plan that delineates long-term agricultural lands. The <br />agricultural preservation plan is adopted under the appropriate municipal <br />or county planning act. Lands planned for long-Term agricultural use and <br />zoned at least quarter/quarter are then eligible for designation as agri- <br />cultural preserves and the benefits and limitations contained in the act. <br /> <br />SECTION 21. (Rules) <br /> <br />Authorizes the commissioner of agriculture to set rules as needed for appli- <br />cation of certain sections of the act. Rule-making is under the administra- <br />tive procedures act. <br /> <br />SECTION 22. (Date of Effect) <br /> <br />Act to become effective on June 1, 1980. <br /> <br />C 0MM E NTS <br /> <br />Since the designation runs with the land, the land can be bought and <br />sold as often as des'ired with no penalty or restriction, except that <br />the use of the land must remain agricultural for duration of the <br />preserve. <br /> <br />There are virtually no limitations on the owner; no ncome requirement, <br />no tenure, no personal limitation other than being a resident of the <br />state or a family farm corporation. <br /> <br /> <br />
