8. That the Subject Property is only separated from Highway 10 by the right-of-way for the <br /> BNSF railroad tracks and is immediately adjacent to the Armstrong Boulevard interchange. <br /> 9. That shared ground signs are permitted where there is a shared entrance for multiple users. <br /> 10. That a shared ground sign shall not exceed 150 square feet for each exposed face nor exceed <br /> an aggregate gross surface area of 300 square feet without the issuance of a conditional use <br /> permit. <br /> 11. That ground signs shall not exceed six (6) feet in height without the issuance of a <br /> conditional use permit. <br /> 12. That the Applicant is proposing a pylon sign that is seventy-five feet (75') tall and 333.5 <br /> square feet in size that includes a decorative base that is six (6) feet in height. <br /> 13. That there are four (4) buildings on the Subject Property with the potential capacity of <br /> approximately seventeen (17) tenants. <br /> 14. That in 2008, Resolution 408-10-203 was approved granting a conditional use permit for <br /> the Subject Property for a ground sign that was thirty-five (35) feet in height and up to 285 <br /> square feet per exposed face or an aggregate gross surface area of 570 square feet. <br /> 15. That this conditional use permit will supersede the provisions of the previous conditional <br /> use permit. <br /> 16. That the completion of the Armstrong Boulevard interchange has resulted in a significant <br /> grade difference, creating a loss of visibility of the current ground sign from Highway 10 <br /> traffic. <br /> 17. That the Applicant has provided an exhibit that demonstrates the proposed height and <br /> location of the proposed sign in relation to the Armstrong Boulevard interchange. <br /> 18. That the approximate proposed location is within a drainage and utility easement in favor <br /> of the City and within an easement in favor of Connexus Energy. <br /> 19. That there is an Encroachment Agreement recorded against the property that addresses the <br /> existing ground sign. <br /> 20. That an Encroachment Agreement would be required to address the proposed sign being <br /> located within the easements in favor of the City and Connexus Energy. <br /> 21.
