Within one year of the date of the recording of the Development Agreement, the Developers <br />shall at their own expense draft and record at Anoka County an easement that sets for the <br />terms of the exclusive and conditional easement. Said easement is subject to the approval of <br />the City. <br />Conditions of this easement shall: <br /> a. Prevent the use of any motorized vehicles in a manner that contributes to erosion or is <br /> unduly detrimental to natural resources. <br /> b. That adequate insurance is maintained by persons benefited by the easement for uses <br /> of said easement. <br /> c. Said easement shall sunset at either the sale of Lot 1, Block 2, to anyone not a direct <br /> heir of the Developers, the resubdivison of Lot 1, Block 2, or at such time as the City <br /> may have in place a hard surface trail on any portion of Parkland that is a result- of this <br /> Development Agreement. However the City' may grant temporary permission in <br /> writing for specific crossing after the termination of the easement. <br /> d. The easement proposed herein shall also 'sunset' if no agreement is recorded within <br /> one year of the recording of the plat. <br /> <br />The cash payment of Park Dedication shall be made to the City prior to the release of the Final <br />Plat for recording. The land portion of this Park Dedication for this minor subdivision is entirely <br />north of Trott Brook. Future subdivision of Lot 1, Block 2 will require additional park dedication <br />according to the dedication schedule in effect at the time of platting. The land dedicated with this <br />plat shall be credit eligible against any other future land required for park dedication purposes if <br />and when Lot 1, Block 2, is resubdivided. <br /> <br />Trail Development Fee. The City has enacted a trail development fee in the amount of ~Four <br />Hundred Seventy Five Dollars and no cents ($475.00) per lot. Lot 1, Block 1, the existing homestehd, <br />is exempt from this fee. Therefore, a payment in the amount of Four Hundred Seventy Five Dollars <br />and no cents ($475.00) shall be paid to the City prior to releasing the Final Plat for recording. <br /> <br />Stormwater Management Fee. The CITY has enacted a Stormwater Management Fee in the <br />amount of Three Hundred Seventy Five Dollars and no cents ($375.00) per unit. Lot 1, Block 1, the <br />existing homestead, is considered by the CITY to be exempt from this fee. The amount of <br />Stormwater Management Fee due on the Plat is Three Hundred Seventy Five Dollars and no cents <br />($375.00). This amount shall be paid to the CITY prior to releasing the Final Plat for recording. <br /> <br />Tree Planting Prior to issuance of a Certificate of Occupancy, the DEVELOPER shall plant two <br />new two-inch diameter overstory trees in the front lot of Lot 1, Block 2. One tree shall be deciduous <br />(min. 2.5" d.b.h.) and one shall be coniferous (min. 6' in height). In addition, the DEVELOPER shall <br />do the fbllowing: <br /> <br />a) <br /> <br />Minimizing the impact of construction on trees in accordance with Minnesota Extension <br />Service publication "Protecting Trees From Construction Damage" (Publication #NR-FO- <br />6135-S). <br /> <br />b) <br /> <br />In the event the weather is not conducive to tree planting at the time of Certificate of <br />Occupancy, the Building Permit holder shall place a cash deposit in the amount of $300.00 <br />[br trees in an escrow account with the CITY and upon verification of the planting being <br />accomplished, said cash deposit shall be refunded to the Building Permit holder.
