NOW, THEREFORE, the CITY and DEVELOPER agree as follows: <br /> <br />SECTION I. <br />IMPROVEMENTS <br /> <br />Access to Lots. Lo~ 1, Block 1, will continue to receive access from Green Valley Road. Lot 1, Block 2, <br />will derive access from 174th Avenue. It is the Developers responsibility to maintain clear access from the <br />dwelling to 174t~ Avenue for emergency vehicle ingress and egress. <br /> <br />Drainage and Utility Easements. The standard 10 foot (5 feet on common property lines) drainage and <br />utility easements shall be dedicated along the perimeter of each of the two lots. Del'ineated wetlands <br />located within the project area must be shown as drainage and utility easements, <br /> <br /> SECTION II. <br />PERMITS AND OCCUPANCY <br /> <br />Requirements for Building and Occupancy Permits. No building permit for any lot in the Plat shall <br />be issued until: (a) a Class 5 driving surface is installed to within 300 feet of the structure; (b) a <br />Certificate of Survey, including that survey information required by the CITY, has been supplied to the <br />City Building Official upon his/her request; and (c) all the financial guarantees required by the CITY <br />have been satisfied. No occupancy permit for any lot in the Plat shall be issued until: (a) all utilities are <br />in place, operational and accepted by the CITY; and (b) landscape trees, or escrow for same, has been <br />provided. <br /> <br /> SECTION III <br />PARKS, TRAILS, STORMWATER, LANDSCAPING <br /> <br />Park Dedication. The Plat is located in the Demerest Brook Recreation District. The existing parcel is <br />21.46 acres. The Plat is creating Lot 1, BlOck 1, an existing 2.50 acre homestead, Lot 1, Block 2, is the <br />creation of a new 18.96 acre parcel with the intent of building 1 hoUse on the new property. The existing <br />homestead on Lot 1 is exempt from Park dedication. The park dedication requirements for the new parcel <br />are 1.89 acres of land (0.1 - 3 units/acre- 10% land, 2004 rate) or a cash payment of $2200 per buildable <br />lot. The applicant is proposing to dedicate 1.01 acres of land as park. This is 53% of the park dedication <br />requirement. The remainder of the park dedication shall be met by a cash payment of One Thousand <br />Thirty Four Dollars and no cents ($1034.00). The land to be dedicated is entirely north of Trott Brook and <br />will be platted as park. <br /> <br />Recognizing the desire of the Developer to maintain access between Lot 1, Block 2 and Outlot A, <br />the following language applies: <br /> <br />Limited crossing of Outlot A by recreational or utility type vehicles, from Lot 2 to Outlot will be <br />permitted provided that: <br /> <br />1. Both parcels continue to be owned by the Developers or their direct heirs. <br /> <br /> <br />
