an unapproved plat made after these regulations become effective. <br />The foregoing provision does not apply to a conveyance if the land <br />described: <br /> <br />Co <br /> <br />Was a separate parcel of record on April 28, 1972; <br />Was the subject of a written agreement to convey <br />entered into prior to April 28, 1972; <br />Was a separate parcel of not less than two and <br />one-half (2-1/2) acres in area and two hundred <br />(200) feet in width on January 1, 1966, or is a <br />single parcel of land not less than five (5) acres <br />and baying a width of not less than three hundred <br />(300) feet. <br /> <br />] 70.03] 2B t-]At~}SHIP <br /> <br />In any case in which compliance with the foregoing restrictions will <br />create an unnecessary hardship and failure to comply does not interfere <br />wJtb the purpose of this chapter, the city council may waive such com- <br />pliance by adoption of a resolution to that effect and the conveyance <br />may then be filed or recorded. <br /> <br />]70.0312C CIVIL PENALTY <br /> <br />Any owner or agent of the owner of land who conveys a lot or parcel <br />in violation of the provisions of this section shall forfeit and pay <br />to the city a penalty as proscribed. The city may enjoin such convey- <br />ance or may recover such penalty by a civil action in any court of <br />competent jurisdiction. <br /> <br />170.03] 3 PIATS Pt~VIOUSLY APPROVED <br /> <br />~1 preliminary or final plats, registered land surveys, or other sub- <br />divisions of land approved but not filed under previous ordinances <br />shall be subject to all requirements of this chapter, but will be <br />reviewed separately on their own merits. <br /> <br />170. 0314 PEDdlTS <br /> <br />170. 0314A IMPROVEMENTS <br /> <br />All electric and gas distribution lines or piping, roadways, walks, <br />and other similar improvements shall be constructed only on a street, <br />alley, or other public way or easement which is designated on an <br />approved plat, or properly indicated on the official map of the city, <br />or which has otherwise been approved by the city council. <br /> <br />170.0314B ACCESS <br /> <br />No permit for the erection of any building shall be issued unless such <br />building is to be located upon a parcel of land abutting on a street <br />or highway which has been designated on an approved plat, or on the <br />official map of the city, or which has been otherwise approved by the <br />city council. This limitation on issuing permits shall not apply to <br />planned unit developments approved by the city council pursuant to the <br />city zoning code. <br /> <br /> <br />
