4. The city engineer shall submit a report to the planning <br />commission before the public hearing, which shall deal with drainage, <br />street ;_md other engineering matters pertinent to said preliminary <br />plat. <br /> <br /> 5. The planning commission shall hold a public hearing on <br />said preliminary plat. Notice of public hearing shall be published in <br />the official newspaper of the city and sent to property owners within <br />three hundred fifty (350) feet of the property to be subdivided at <br />]east ten (10) days prior to the hearing date. Public notice shall <br />consist of a general descriptJon of the proposal, the time, date and <br />place of hearing. For the purpose of notification, ownership of <br />property within three hundred fifty (350) feet shall be determined <br />by records on file in the city assessor's office. In case the plat <br />5s disapproved, the subdivider shall be notified of the reason for <br />such action. The notices and publications as required hereunder <br />shall be done by the zoning officer and shall be paid by the subdi- <br />vider. The planning commission shall conduct the hearing on the <br />preliminary plat and shall make its report to the city council at <br />its next meeting which falls at least fourteen (14) days after the <br />planning commission's public hearing. It shall be the duty of the <br />planning commission to determine whether the preliminary plat con- <br />forms with or exceeds the design standards established by this chap- <br />ter. The decision of the planning commission with regard thereto, <br />together with its recommendations, shall be included in its report <br />to the city council. <br /> <br /> 6. After the city council receives the report of the plann- <br />~ng commissJon, the council shall act to approve or disapprove the <br />preliminary plat. If the council shall disapprove said plat, the <br />grounds for any such disapproval shall be set forth in the proceedings <br />of tbe co~mcil and reported to the subdivider within seven (7) days <br />thereafter. In its discretion, the council may hold a public hearing <br />on the plat. The council shall publish notice of the hearing as pro- <br />vided herein, at the subdivider's expense, but written notice of said <br />hearing need not be given the' adjacent landowners. <br /> <br /> 7. Ail engineering considerations presented in the prelimin-. <br />ary plat and data furnished by the subdivider, the city engineer's <br />report, and any such reports introduced at any time during the proceed- <br />ings shall be resolved prior.to the approval of the preliminary plat <br />by the city council. <br /> <br /> 8.
