within thirty (30) days after receipt from the planning commission. <br />If the city council denies the application, that action shall be the <br />city's final administrative ~ction on the application. <br /> <br /> 3. If the city council approves the application, as a con- <br />dition of that approval, the council may attach such conditions as <br />it deems necessary. Ail development, construction and use shall be <br />in accordance with the approved plan and conditions required by the <br />city council. Any development not in accord with the approved plan <br />and conditions shall constitute a violation of this chapter. The <br />conditions imposed shall be imposed only in order to protect the <br />public health, safety, convenience and welfare or to avoid traffic <br />congestion or hazard, or other dangers, or to promote conformity <br />of a proposed use with the character of the adjoining property and <br />uses, and the district as a whole, or to protect such character. <br /> <br /> 4. The term of a conditional use permit issued herein <br />shall be indefinite and may be revoked only upon an affirmative show- <br />ing that the site is not being used for the use priginally authorized <br />in the conditional use permit issued and in accord with the conditions <br />attached by the city council. <br /> <br /> 5. In approving or disapproving the application, the city <br />council shall adopt written findings detailing the reasons for its <br />action. <br /> <br />170.016D STANDARDS FOR CONSIDERATION <br /> <br />In making the determination of whether or not the conditional use is <br />to be allowed, the city shall consider the following: <br /> <br />a. The nature of the land upon which the use is to be <br /> located; <br />b. The nature of the adjoining land or buildings; <br />c. The proximity of a similar use; <br />d. The effect upon traffic into and from the premises, <br /> or on any adjoining roads; <br />e. The total number of similar uses within the city; <br />f. Whether or not the use will be dangerous or other- <br /> wise detrimental to persons residing or working <br /> in the vicinity of the use, or to the public wel- <br /> fare, and whether or not it will substantially <br /> impair the use, enjoyment or value of any property. <br /> <br />170.016E CRITERIA FOR APPROVAL <br /> <br />A conditional use shall be approved if and only if it is found to meet <br />all of the following criteria: <br /> <br /> a. That the establishment, maintenance or operation <br /> will not be detrimental to or endanger the public <br /> health, safety or general welfare and is not con- <br /> trary to established standards, regulations or <br /> ordinances of other governmental agencies; <br /> b. That each structure or improvement is so designed <br /> <br /> <br />
