Community Development Director Frolik reiterated that this development will still need to <br />receive final site plan approval prior to issuance of a building permit and plat release. The final <br />site plan will review the outstanding issues related to the development including landscaping, the <br />grading and drainage plan including the use of innovative ston-n water management techniques, <br />utilities, and street construction. A secondary development ag-reement will. also need to be <br />approved at that time. She noted that storm sewer charges Will be collected as part of the site <br />plan approval. Staff is recommending approval of the final plat contingent upon compliance <br />with City Staff Review Letter dated July 9, 2004, final site plan approval, and the Applicant <br />entering into a Secondary Development Agreement with the City. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Elvig, to adopt Resolution #04- <br />0'7-184 apProving the final plat of the Ramsey Town Center 4'h Addition. <br /> <br />Motion carried. Voting Yes: Mayor Gm'nec, Councilmembers Cook, El;rig, Pearson, Strommen, <br />and Zimmennan. Voting No: None. Absent: Councilmember Kurak. <br /> <br />Case #10: Request for Exception from DeveloPment Moratorium; Case of John Rowe <br /> <br />Community Developrnent Director Frolik explained that the R-1 Residential Rural Developing <br />district is currently under a moratorium for the subdivision of land. The purpose of the <br />moratorium is to provide the City with the opportunity to perfon'n a comprehensive planning <br />process to determine how growth will occur outside of the current urban service area. The <br />moratorium is currently in effect to about Septernber 14, 2004. She stated the moratorium <br />ordinance provides for exceptions when compliance may result in undue hardship. The Council <br />has the authority to ~m'gnt an exception to the moratorium with conditions desirable for the <br />protection of the public interest. No exception is to be ~anted unless the CiW Council finds the <br />fbllowing: <br /> <br />That there are special circumstances or conditions affecting the property in question such <br />that strict' compliance would deprive the petitioner of reasonable use of the property. <br /> <br />2. That the exception is necessary for the preservation of a substantial property right. <br /> <br />That the g/ranting of the exception will not be detrimental to the public welfare or <br />injurious to other property in the area. <br /> <br />That the exception will be harmonious with and in accordance with the objectives of the <br />City's existing Comprehensive Plan and will not adversely affect the planning process for <br />adoption of amendments to the Comprehensive Plan. <br /> <br />That the proposed subdivision will be consistent with the intent 'and purpose of the <br />moratorium Ordinance. <br /> <br />Recently, Mr. Rowe purchased the Green Valley Greenhouse and homestead at 6530 Green <br />Valley Road from his brother-in-law, Wayne Davis.
