7, That the existing detached garage is now considered lawful nonconforming. <br /> <br />That Section 9.03.14 (Non-conforming Structures and Uses) states that any legal non- <br />confbrming building/structure or use shall not be enlarged or reconstructed, but may be <br />continued at the existing size and in the same manner of operation as existed at the date when <br />it became classified as non-conforming. <br /> <br />9. That the Subject Property is approximately 400 feet in length, and the home is approximately <br /> 290 feet from the f¥ont property line. <br /> <br />10. That the existing detached garage is approximately 200 feet from the front property line. <br /> <br />11. That the property is eligible for a maximum of 1,664 square feet of accessory building space. <br /> <br />12. That in addition to the detached garage, there is a single-stall attached garage that is 308 <br /> square feet h~ size. <br /> <br />13. That the Applicant is proposing to construct an addition, totaling 960 square feet (24' x 40'), <br /> on the existing detached garage. <br /> <br />14. <br /> <br />That the square footage of the proposed addition, coupled with the square footage of the <br />existing accessory buildings, would exceed the maximum allowable square ~botage ~br the <br />Subject Property and thus, will also require a Conditional Use Permit. <br /> <br />15. That the proposed addition would have a setback from tl~e front property line of <br /> approximately 175 feet. <br /> <br />t 6. That the proposed addition would exceed both the rear and side yard setback requirements. <br /> <br />17. <br /> <br />That the eastern portion (side and rear of the property) of the Subject Property is heavily <br />wooded with mature oak trees which provide screening from the new Alpine Acres <br />development. <br /> <br />18.' That the Applicant wants to construct the proposed addition in such a location to eliminate <br /> the need to remove mature oak trees on the Subject Property. <br /> <br />19. That if the addition were on the east side of the existing detached garage, a group of about ten <br /> (10) mature oak trees would need to be removed to facilitate the construction. <br /> <br />20. That the proposed addition to the detached garage would be setback further from Sunfish <br /> Lake Blvd than the principal structures on the adjacent two properties. <br /> <br />21.
