4 <br />Regular Planning & Zoning Meeting <br />June 4, 1979 <br /> <br />Regarding Item No. 5 of Engineer R~tikka's letter, only one access to the <br />plat. Mr. Klemish pointed out that Shady Lawn Estates had only one access <br />until he built his other addition and provided a second access. <br /> <br />Engineer Raatikka noted that plats 'having only one access have been approved <br />in the past. He sited examples; Shady Lawn Estates, Barthel's Rum River Acres., <br />Woodlawn Estates. <br /> <br />Art Dunn pointed out that the streets in Shady Lawn Estates are City. streets. <br />Attorney Goodrich stated that they are public dedicated streets. <br /> <br />Regarding Item No. 6, on soil borings. Chairman Ken Peterson said he feels <br />it will be best handled by having the City Building Inspector make a determination <br />on each individual building permit request~ as to whether or not soil borings are <br />necessary. <br /> <br />Regarding park land. Kathy Schneider suggested that Mr. Klemish work out somm <br />kind of agreement with flae City Council and the Park Depart~n=nt to make up the <br />deficiency in the an~unt of park land in a cash dedication. <br /> <br />Art Dorm pointed out that the triangular shaped piece of land north of Trott <br />Brook in the northwest cornere of Mr; Kl~sh's plat would be-landlocked and <br />would result in a metes and bounds description of less than five acres. <br /> <br />Mr. Davis, who is the owner of the other triangular shaped piece of property <br />to the northeast side of Mr. Klemish's property, was present in the audience. <br /> <br />A discussion was held regarding his! land also being .landlocked if he. were to <br />develop it in the future. As a result, it was recommended by the Conmission <br />that Mr. Klemish try t° enter into some sort of an agre~mgn_~ t with Mr. Davis to <br />trade these pieces of land and thereby Mr. Kl~n~sh could satisfy the park <br />land dedication req, drement. It was also noted that it would be to Mr. Davis' <br />benefit to make this trade. <br /> <br />.~otion by Kathy Schneider and seconded by John Hubbard to reconraend that the <br />City Council grant prel~m4nary plat approval for Ed Klemish's .plat now called <br />Trott Brook Estates, subject to the following: <br /> <br />That prior to final plat approval the developer obtain the <br />approval from the utility companies to cross the easements with the <br />proposed streets.. Also that the gas and power companies be made <br />aware of any on-site sewage disposal systen~ to be constructed on <br />their easement. <br />That a variance be granted for th~ cul de sacs which are over 700 <br />feet in length. The .reason being thmt it is for a natural extension <br />of the street and to provide future access to the. proper~y. <br />That the condition of the streets in Shady Lawn Estates be reviewed <br />to assure that they are adequate for the projected traffic from the <br />proposed plat. It is reco~m=nded that streets be ~xpgraded if necessary <br />to handle the additional traffic. <br />That a var4ance be granted to Article 170.038I{ and the City Inspector <br />will review each lot at the t~m~ the build~ng permit is applied for in order <br />to assure proper indivichml sewage treatment systems as required by City <br />Code. <br /> <br /> <br />
