Administrator Schnelle cautioned that P a Z Commissioners should
really define what they want in the agreement so the City and.
Mr. Aydt do not end up spending money in attorney fees if at some
time in the future a unpleasant situation should arise.

Chairman ?eterson stated that if Mr. Aydt did ever sell his
business that he would like to have the potential buyer appear
before the Commission before the purchase to review the conditional
use with the buyer.

Rev:iew of the proposed conditional use agreement:

No. 1 and 2 - stay the same as proposed.
No. 3 - The permittee shall be able to sell occasional cars
and trucks with a maximum of three on display at one time on the
easterly side of the property.

No. 4 Outside storage of auto parts shall be:,:visually screened
with something compatible with the area.

No. 5 - A fenced in storage lot for. damaged and towed in autos.
and trucks comprising an area of 20,000 square feet with a six
foot high fence to adequately screen the storage lot.

No. 6 No salvage yard or junk yard activities to be carried
on at anytime. (The intent is to prohibit solicitation and sales
of auto parts).

No. 7 Prior to the sale of the business, the Conditional use
permit is subject to review upon change of ownership 'and/or
operation and upon violation of the above Agreements.

l)iscussion held regarding No. 5 - Chairman Peterson had
suggested the area be only 10,000 square feet but Mr. Aydt
wanted a larger area in case he wanted to include fencing in
his shop area. Art Dunn stated that he did not see any reason
to put a size on it until he 'knew for sur. e just where the fence
would be installed. It was consensus of the Commission to have
Mr. Aydt indicate on a site plan map drawing of the acre shop
area where the fenced area would be situated and that he could
have a maximum of 20,000 square feet of fenced in storage yard.
Ro~ West said he would go along with a cha,in link fence but that
~t wou]d be a maintenance problem, he could have colored slats
or wooden slats and that in the long run the wooden slats would
be less expensive due to less maintenance.

Motion by Art Dunn and seconded by Ben Deemer to recommend that
the City Council grant the conditional use agreement to Mr. Aydt
as proposed with the above changes.

Mot2on carried. 5 - 0.

P & Z Regular Meeting
11/5/79
~a§e 4
