9. That approval of the exact location of the Sign on the Subject Property is subject to approval <br />by the City and Connexus Energy due to the existence drainage and utility easements. The <br />Permittee shall submit a certified Site Plan and Survey that shows the footing(s) for the Sign <br />as well as all existing utilities (small utilities and sanitary sewer, water, and storm Sewer pipes) <br />and vertical and horizontal clearances between the footing(s) and utitilies. <br />10. That the Permittee shall execute an Easement Encroachment Agreement with both the City <br />and Connexus Energy acknowledging that it, and its successors or assigns, is responsible to <br />relocate the Sign if necessary to facilitate authorized work within the easement area. <br />11. The Permittee shall not install the Sign within the vision clearance triangle as defined in <br />Section 117-348 (g) of Ramsey City nor within any easement on the Subject Property. <br />12. The Sign shall be properly constructed and maintained in accordance with Division 8 (Signs) <br />Section 117-522 (Construction Specifications) of the Ramsey City Code <br />13. The Permittee shall be responsible for all City costs incurred in administering and enforcing <br />this Permit. <br />14. The City Administrator, or his/her designee, shall have the right to inspect the Subject <br />Property for compliance and safety purposes annually or at any time, upon reasonable request. <br />15. Should any provision of this Permit be declared void or unenforceable, the other provisions <br />shall not be affected but shall remain in full force and effect. <br />16. This Permit shall not be considered modified, altered, changed or amended in any respect <br />unless in writing and signed by the City and the Permittee. <br />17. That the Permittee and its successors or assigns herein agree not to hold Connexus Energy nor <br />the City, both of which hold easements over the designated sign location, responsible for any <br />damage to the sign that may result from authorized work occurring within the easement areas. <br />18. That if the Permittee or its successors or assigns violates any material term or condition of <br />this Permit it is grounds for suspension or revocation hereof consistent with applicable law, if <br />the City Council reasonably determines that continued operation of the facility places the <br />public health, safety or welfare or the environment in jeopardy or creates a public nuisance due <br />to odors, litter, debris or other nuisance factors. <br />19. That this Permit shall become null and void if the use is not initiated by November 22, 2017. <br />Issuance of a Sign Permit for the Sign shall be considered initiating the use. <br />The motion for the adoption of the foregoing resolution was duly seconded by Councilmember <br />Shryock, and upon vote being taken thereon, the following voted in favor thereof: <br />Mayor Strommen <br />Councilmember LeTourneau <br />Councilmember Shryock <br />RESOLUTION #16-11-211 <br />Page 2 of 4 <br />
