Within a reasonable time after the hearing, the Board of Adjustment shall make its order deciding the matter and serve a copy of such order upon the appel]ant or the petitioner by mail. If tbe city council does not act as the Board of Adjustment', the Board of Adjustment's decision may be appealed to the city council. The city council, after revieu of the Board of Adjustment's minutes, records and fi]es, may affirm, reverse, or modify the Board of Adjustment's action. If the city council acts as the Board of Adjustment, or after the city council acts on a Board of Adjustment's decision, this shall be the final action or the city on the variance application. ] 70. 019 A~II!ixqP:.~NTS ] 70.0]'.9A 7~x~NDi,~-iNTS The city council may amend this chapter as proposed by a member of the city council; by the planh5ng commission, or by a petition of a person residing or owning property within the City of Ramsey, in accordance with the following provisions: ]70. 019B PRO[~I)[IRE l. Petitions for amendment shall be filed with the planning conlmJssJ, on and the petitioner, upon such filing, shall pay an advertis- ing depos5t and a filing fee in accordance with a schedule annually affixed by resolution. The planning commission shall review the pro- posed amendment and report its findings and recommendations in writing to the city council and to the petitioner. The proposed amendment shall be introduced before the city council only if a member of the city council e]ect~ to do so. If an amendment proposed by petition is not introduced, the advertising depsoit shall be refunded to the petitioner; otherwise such deposit shall be paid to the city. 2. Any proposed amendment, introduced by a member of the city council without written findings and recommendations from the planning commission sba]_] be referred to the planning commission for review at ]east: thirty (30) days prior to public hearing by the council. The city council may not act upon the proposed amendment until sixty (60) days have elapsed from the date o$ reference of the amendment without_ a report from the planning commission. 3. Before voting on the enactment of an amendment, the city council shall hold a public hearing thereon, pursuant to public notice. It shall be the responsibility of the zoning officer to have notice of the time, place, and purpose of the public hearing published in the -official city newspaper ten (10) days prior to the bearing. Also, when an amendment involves changes in district boundaries affect- Jng an area of five (5~ acres or ]ess, a written notice of the hearing stating its time, place, and purpose, shall be mailed by the zoning officer at ]east ten (10) days before the day of the hearing to each owner of affected property and property situated wholly or partly with- in three hundred fifty (350) feet of the property to which the amend- ment relates.
