Per- <br />m~ss~on to develop specific parcels of land under the provisions which <br />fo]lox., sha].l be binding on all construction. Any proposed change in <br />the development plan aft'er approval by the city council shall be resub- <br />mitted for consideration. The ]and use, minimum lot area, yard, height <br />and accessory uses determined by the planned unit development require- <br />ments shall prevail over conflicting requirements listed elsewhere <br />wJ thin this code. <br /> <br />PRI/L] H] NARY DEVELOP/qE.,TF PLAN PROCEDURE <br /> <br />An applicant for a planned unit development shall submit a preliminary <br />development plan to the zoning officer with a written statement and a <br />certified check or money order in an amount to cover all the costs <br />incurred 5n checking and processing such plans. <br /> <br /> 1. Within sixty (60) days after the filing of the preliminary <br />plan with the zoning officer, the planning commission shall forward the <br />plan to the c~ty council with a written report recommending that the <br />plan be d~sapproved, approved, or approved with modifications, stating <br />the reasons for these recommendations. <br /> <br /> 2. Within forty-f2ve (45) days after the receipt of the <br />application by the c2ty council, a public bearing shall be held by <br />the city counci] on the application. The city council may continue <br />the hearing or refer the matter back to the planning commission for <br />further study; provided, however, that the public hearing or bearings <br />shall be concluded within forty-five (45) days after the date of the <br />first public }rearing, unless the applicant shall consent in writing to <br />an extension of the time. Upon conclusions of all hearings, the city <br />council sba21 within thirty (30) days make and file findings and cause <br />a copy thereof to be mai]ed to the applicant. <br /> <br /> 3. In the event tentative approval is granted subject to <br />conditions, the app]icant shall, within forty-five (45) days after <br />receiving a copy of the findings of the city council, notify the <br /> <br /> <br />
