I <br />I <br />I <br /> <br /> PROPOSED <br /> FINDINGS OF FACT <br /> <br />CONDITIONAL USE PERMIT <br /> FOR GROUP W CABLE <br /> <br />1) That the Applicant has properly applied for a conditional use permit as required <br />by Ordinance to construct a microwave tower which exceeds the City of Ramsey's height <br />regulations, as well as construct an accessory building for housing related equipment <br />on an outlot in a residential zone. <br /> <br />I <br />I <br />I <br />I <br /> <br />2) That the Applicant appeared before the City of Ramsey's Planning and Zoning Com- <br />mission for a public hearing pursuant to the City Zoning Ordinance on December 7, 1982 <br />and that said public hearing minutes are hereby incorporated as a part of these findings <br />by reference. <br /> <br />3) That said public hearing was properly advertised in the official City newspaper <br />and that the adjoining property owners were notified of said public hearing in accord- <br />ance with City Ordinance. <br /> <br />4) That the Standards for Consideration are as follows: <br /> <br />a) The property is zoned R-1 and this is not a permitted use. <br /> <br />b) That the tower height exceeds the thirty-five feet (35) permitted by <br />Ordinance. <br /> <br />'1 <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> I <br /> <br />c) That the adjoining properties are residential dwellings located on one <br />acre parcels. <br /> <br />d) That the subject property is approximately two acres in size. <br /> <br />e) That the proposed tower shall be so located so its collapse in any <br />direction would not do damage to any adjoining properties. <br /> <br />f) That the closest similar use, the local radio station, is located within <br />approximately two miles of this site. <br /> <br />g) That there shall be no adverse effect to traffic flow in the area~ <br /> <br />h) That there are no other known microwave towers located within the City <br />of Ramsey. <br /> <br />i) Properly maintained, the microwave tower and accessory building will- not <br />affect the lifestyle of the neighboring residents in a residential setting, <br />Further, it should not affect the enjoyment or substantially impair the use <br />of any adjoining property. <br /> <br />5) That the Criteria for Approval are as follows: <br /> <br />a) That the establishment, maintenance and operation of this project will <br />not be detrimental to or endanger the public health, safety or general <br />welfare and is not contrary to established standards, regulations or <br />Ordinances of other governmental agencies. <br /> <br />b) That the structures are so designed that they are not unsightly, undesirable <br />or obnoxious in appearance and they will not hinder the orderly and harmon- <br />ious development in the district wherein proposed. <br /> <br /> <br />
