I I I PROPOSED FINDINGS OF FACT CONDITIONAL USE PERMIT FOR GROUP W CABLE 1) That the Applicant has properly applied for a conditional use permit as required by Ordinance to construct a microwave tower which exceeds the City of Ramsey's height regulations, as well as construct an accessory building for housing related equipment on an outlot in a residential zone. I I I I 2) That the Applicant appeared before the City of Ramsey's Planning and Zoning Com- mission for a public hearing pursuant to the City Zoning Ordinance on December 7, 1982 and that said public hearing minutes are hereby incorporated as a part of these findings by reference. 3) That said public hearing was properly advertised in the official City newspaper and that the adjoining property owners were notified of said public hearing in accord- ance with City Ordinance. 4) That the Standards for Consideration are as follows: a) The property is zoned R-1 and this is not a permitted use. b) That the tower height exceeds the thirty-five feet (35) permitted by Ordinance. '1 I I I I I I I I I c) That the adjoining properties are residential dwellings located on one acre parcels. d) That the subject property is approximately two acres in size. e) That the proposed tower shall be so located so its collapse in any direction would not do damage to any adjoining properties. f) That the closest similar use, the local radio station, is located within approximately two miles of this site. g) That there shall be no adverse effect to traffic flow in the area~ h) That there are no other known microwave towers located within the City of Ramsey. i) Properly maintained, the microwave tower and accessory building will- not affect the lifestyle of the neighboring residents in a residential setting, Further, it should not affect the enjoyment or substantially impair the use of any adjoining property. 5) That the Criteria for Approval are as follows: a) That the establishment, maintenance and operation of this project will not be detrimental to or endanger the public health, safety or general welfare and is not contrary to established standards, regulations or Ordinances of other governmental agencies. b) That the structures are so designed that they are not unsightly, undesirable or obnoxious in appearance and they will not hinder the orderly and harmon- ious development in the district wherein proposed.
