I I I -2- WHEREAS, Ramsey is unwilling to permit any subdivision of the subject parcel and/or issue more than one building permit for said parcel. I I I I I I NOW, THEREFORE, The parties hereto agree as follows: 1. That Ramsey will issue to Phelps a variance in recordable form granting Phelps a variance to Ramsey Code Section 170.0314B such that one, and only one, building permit for a single family residence can be issued on the following described property, to-wit: That part of Government Lot 4, Section 1, Township 32, Range 25, Anoka County, Minnesota; lying North of Trott Brook. 2. That Phelps agrees on behalf of himself, his heirs and assigns to hold Ramsey harmless from any and all causes of action relating to the inability of emergency vehicles to use the private driveway to his residence as described above. I I I 3. That access to said Government Lot 4 shall be by the following legally described private easement, to-wit: The West 66 feet of the East 250.81 feet of the Northwest Quarter (NW 1/4) of the Southwest Quarter (SW 1/4) of Section 1, Township 32, Range 25, Anoka County, Minnesota. 4. That Phelps, his heirs and assigns, shall be unable t° subdivide said I I Government Lot 4 unless and until Ramsey's subdivision regulations are fully complied with and under no circumstances wilI more than one residential unit be permitted to u~e as access the private easement above described.
