AGREEMENT <br /> <br /> THIS AGREEMENT is by and between Harold A. Phelps and Meryl J. Phelps. <br />hereinafter "Phelps", and the City of Ramsey, hereinafter "Ramsey". <br /> <br />WHEREAS, Phelps has applied to Ramsey for a variance to its subdivision <br />code in order to construct a single family residence on the following described <br /> <br />parcel, to-wit: <br /> <br /> 'That part of Government Lot 4, Section 1, Township 32, Range 25, Anoka <br /> County, Minnesota; lying North of Trott Brook. <br /> <br />and <br /> <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />and <br /> <br />WHEREAS, said parcel does not have direct public access to a public streetf <br /> <br /> WHEREAS, Phelps has obtained a private easement to serve said property, <br />which easement is described as follows, to-wit: <br /> <br />and <br /> <br />The West 66 feet of the East 250.81 feet of the Northwest Quarter (NW <br />1/4) of the Southwest Quarter (sw 1/4) of section 1, Township 32, Range <br />25, Anoka County, Minnesota; <br /> <br /> WHEREAS, Phelps, his heirs or assigns, by executing this Agreement, <br />understands and agrees to (1) accept all responsibility and liability and (2) to <br />hold Ramsey harmless from any and all causes of action of whatever nature which <br /> <br />I <br />I <br />I <br /> <br />may arise as a result of emergency vehicles being unable to properly serve <br />either the home to be built on the subject premises or its residents which <br />inability may be created because the private easement driveway serving the home <br />is inadequate in whatever manner; and <br /> <br /> WHEREAS, Phelps, his heirs or assigns u'nderstands and agrees that Ramsey <br /> <br />I <br />I <br /> <br />will have no responsibility for maintenance of the private driveway easement of <br />whatever nature including snowplowing; and <br /> <br /> <br />
