Chairman Peterson then referred to inadequacies in distribution of public <br />hearing notices, and requested Commission members to come u~ with some ideas <br />for improving that distribution process. <br /> <br />Mr. Berg replied that in cases where there are unrecorded contracts, there is <br />no way of notifying those people without contacting them personally. <br /> <br />Commissioner Deemer stated 'that that is the way it should be done, that he has ' <br />been required to find out for himself just who should receive notification. <br />That way Council has the recourse of conducting another public hearing if <br />notices were deficient because of an error on the part of the developer. <br /> <br />Commissioner Dunn disagreed with Commissioner Deemer. <br /> <br />Commissioner LaDue agreed with COmmissioner Deemer, that the burden of <br />notification should fall on the developer, <br /> <br />Brenda Bauerkemper - Statute states that a "reasonable attempt" must be <br />made regarding public hearing notice distribution and if all affected persons <br />are not notified, it does not invalidate Council proceedings. <br /> <br />Jeanne Schlueter - Stated that she would be upset if she were not notified of <br />a public hearing that affected her property, but there should also be some <br />responsibility on the part of the citizen owning property that is not <br />recorded to let the City know where they are located and hOw.~then ~an~be <br />contacted should it every~be necessary. <br /> <br />Commissioner Zimmerman stated that having the City responsible for public <br />hearing notification could be more fair because a developer could choose to <br />omit certain persons he knows are in opposition to his proposal. <br /> <br />Mr. Berg commented that the percentage of those not receiving notification <br />in each particular case, is really very low. <br /> <br />Commissioner Isakson suggested that Chairman Peterson find out from City <br />Attorney just what the City's legal responsibility is regardi~n§ public <br />hearings and what is meant by "reasonable attempt." <br /> <br />Commissioner Dunn stated that regarding sewer and water workshops, the <br />minutes are included in tonights agenda and there is a public informational <br />meeting scheduled for April 19, 1983 at the Ramsey Elementary School. <br /> <br />Commissioner Isakson stated that he was encouraged by the show of interest <br />at the two workshops. <br /> <br />Chairman Peterson stated that he commented to the Mayor that input from <br />P&Z was not requested in some areas and the Mayor's reply was that if <br />P&Z wants to get involved, P&Z will have to take the initiative. <br /> <br />Commissioner Dunn noted that the Comprehensive Plan was changed on 2/22/83 <br />regarding placement of sewer and water without input from P&Z, decision <br />regarding proposed siting of hazardous waste in the City was made without <br />P&Z input, Site P was opposed by Council without input from ~&Z. It seems <br />P&Z input,on matters we were appointed to assist on, is being overlooked. <br />To not have had the opportunity to make recommendations is different than <br />Council overruling P&Z recommendations..
