Voting Yes: Chairman Peterson, Commissioners Dunn, Zimmerman, <br />Deemer, Schneider and LaDue. Voting No: None. Absent: Commissioner Isakson. <br /> <br />'Commission discussed letter from R.W. Peterson and Mr. Berg commented that <br /> ordinance states that you cannot park more than a one ton truck in a platted <br /> area and the area being discussed tonight is unplatted. Mr. Berg further <br /> stated that he hopes this problem will be solved during recodification. <br /> (Mr. R.W. Peterson's letter not only opposed Mr. Nedry's request, but also <br /> included complaints that there is a beauty shop in the area already and semi- <br /> trucks are being parked in the area). <br /> <br />Commissioner Schneider requested that Mr. Berg contact Mr. R.W. Peterson and <br />explain that the parking of semi-trucks in the area will be resolved during <br />recodification and that the beauty shop is paying commercial taxes. <br /> <br />Motion by Commissioner Zimmerman and seconded by Commissioner Dunn to recommend <br />approval of Mr. Thomas Nedry's request for a conditional use permit based on <br />the findings of fact and further to include the following conditions: <br /> <br />1. That on-street parking be curtailed. <br />2. Retail sales shall not be advertised as a part of the business. <br />3. Advertisement sign shall be in compliance with City Ordinance. <br />4. Applicant shall be sole operator of the business. <br /> <br />Motion carried. Voting Yes: Chairman Peterson, Commissioners Dunn, Zimmerman, <br />Deemer, LaDue and'Schneider. Voting No: None. Absent: Commissioner Isakson,.'~. <br /> <br />Case #4: Mr. Lyle Illg; Request For Variance To Purchase 100' Wide Parcel: <br /> <br />Mr. [yle Illg was present and stated he would like a variance to purchase <br />a 100' wide parcel abutting his property from the rear in order to obtain <br />access to his rear property. Mr. Illg stated that his current parcel is 100' <br />wide also. <br /> <br />Mr. Berg stated that approval of Mr. Illg's request would be a subdivision and <br />create two other parcels. This subdivision does not comply with subdivision <br />ordinance and Comprehensive Plan. <br /> <br />Commission reviewed the situation and suggested that Mr. Illg negotiate a <br />private agreement with the landowner. <br /> <br />Case #3: Informational: <br /> <br />Commission discussed the final decisions made by City Council regarding <br />Phelp's and Gilbertson cases. Commission agreed that the Phelps case is <br />setting a precedence. <br /> <br />Commissioner Deemer noted, regarding Gilbertson case, the addition of Item #11 <br /> <br />P & Z/May 3, 1983 <br /> Page 3 of 5 <br /> <br /> <br />
