F]NAI. 1)liVl!lDl)bfl~T Plain PROCI!I)UI~ Within six (6) months roi]owing the approval of the preliminary develop- mttnt plan, the applicant shall file with the zoning officer a final dew. lopmen~ plan containing in f~nal form the information required in the preliminary plan. The city council, at its discretion, may extend for six (6) months the period for fJl$ng of the final development plan.' 1. The zoning officer shall send a reproducible print and One (]) other print to the chairman of the city planning commission. If the planning commJs.sion finds that the final plan is in substantial compliance with the plan given preliminary approval, it shall endorse the plan and submit it to the city council within thirty (30) days. 2. A public hearing on an application for final approval of the plan or part thereof shall not be required, provided that the plan 5s 5n substantial compliance with the plan given preliminary approval. 3. In the event the plan, as submitted for final approval, 5s not in substantial compliance with the preliminary plan, the city council shall notify the applicant within forty-fi~e (45) days of. the date of applicatJ, on setting forth the ways in which'the plan is not in substantial compliance. The applicant may treat sudh notification as denial of final approval; or The applicant may refile his plan so that it does substantially comply with the preliminary plan; or The app]5cant may file a written request with the city council, that it hold a public hearing on his request for final approval. Any such hearing shall be held within thirty (30) days after the request for such a hearing. Within forty-five (45) days of such hearing, the city council shall either grant final approval or deny final approval to the plan. 4. In the event a plan is given final approval and the applicant shall abandon said plan, or in the event the applicant~ shall fail to begin construction of the planned unit development within tweJve (12) months after the final approval has been granted, final approval shall terminate unless such time period is extended by thc city counc.i1.
