City Engineer Raatikka' s reply to Mr. Martin's concerns regarding Section <br />170.0112D(c) Item (b) was that the d_eveloper must maintain a density of at <br />least 10 trees per acre and the crown cover should not decrease more than <br />50%. <br /> <br />Mr. Martin replied that the wording is not clear and the City should be sure <br />of what it says before they try to enforce it. <br /> <br />Chairman Peterson stated that at the time of development, plans showing <br />existing trees and those that are to be removed will be required. <br /> <br />Mr. Raatikka stated that the omdinance would allow clear cutting crown cover <br />200' from bluff point. <br /> <br />Commission consensus is that developer is not obligated to replace trees <br />which need to be removed because of serious storm damage, disease or other <br />acts of God. <br /> <br />Mr. Raatikka's reply to Mr. Martin regarding his concern with Section 170.0112F, <br />was that this section was prepared from a model ordinance sent out by the <br />Metro Council. ~ <br /> <br />Mr. Berg noted that most or the information that this section ~equires of <br />the developer is shown on the plat anyway. <br /> <br />Mr. Martin stated that this section requires some very detailed reports which <br />could be costly and time consuming. <br /> <br />Mr. Raatikka stated that the requirements in this section could be reduced. <br /> <br />Mr. Berg stated that the City would not require such detail, but rather a <br />more broad plan. <br /> <br />Mr. Berg, in reply to Mr. Martin's concern regarding Section 170.0112G(d), <br />stated that this section is speaking of alterations to the site itself; <br />that this will provide the City assurance of what the developer is doing to <br />the bluff line and it does not deal with utilities, streets, etc. <br /> <br />Regarding Section 170.013D(5), Mr. Martin stated that he has a 3.'5 acre <br />tract that was established prior to the Critical Rivers legislation, and <br />he has been assured in previous meetings with P&Z and council that a variance <br />would be worked out for this tract to be developed into two unsewered lots <br />and there are not provisions in this ordinance for a variance for hardship. <br /> <br />Mr. Raatikka stated that the street (139th) could be included in the total <br />acreage. <br /> <br />Mr. Schnelle stated that there would still be a density problem. <br /> <br />Chairman Peterson stated that a variance procedure could be added to the <br />ordinance. <br /> <br />Mr. Schnelle stated that this discussion regarding a variance should be <br />documented for future reference 'if and when a variance is requested. <br /> <br />Commissioner Deemer stated that the Zoning Code should cover variances of <br />this type. - <br /> <br />P&Z/August 2, 1983 <br /> <br /> <br />
